Some Ebay advice please

    Have you just emailed them or have you filed a claim? An email may not be seen for a day, but if you file a claim (login, go to resolution centre then file a claim) it should freeze the funds in the seller's account until it is resolved. Hopefully you can do this before he has time to withdraw the money

    I don't think a claim can start though until a week after payment has been sent?

    I have just tried to contact him through his mobile (got it from Ebay) and he denied his name was Steven Gibson, (the seller) and put the phone down on me. I have filed a disput with paypal to get the ball rolling. Next call is to my credit card, then my shotgun..:mad: :mad:

    no expert on this but I do know that it is very hard to shut an ebay account down - having tried before you have to leave the account for - 6 weeks or maybe 6 months with no activity before you can do it. The point being that ebay have shut this account down not the seller so I would be asking ebay questions as to why they have shut this sellers account down they must have grounds for suspicion and surely you could use there grounds for suspicion in your present dealings with paypal and CC company and possibly the police.

    And isn't steve gibson the chairman of Middlesbrough FC? Might be a wind up name.

    Dodger65, I think we have all assumed that buyer has been NARUd, not that he closed his account voluntarily. It looked rather odd a brand new seller with only three very expensive items for sale.

    Unfortunately the police etc are unlikely to be interested, it is the bloke in the pub scenario again, the buyer willingly sent money to an unknown person with no feedback and whilst it definitely looks dodgy it would be too early yet for anyone to state 100% that the item will not be delivered.

    The OP can really only hope that he can get the sellers paypal account blocked before funds are removed, and failing that get assistance from the cc company.

    "NARUd" what's that then?

    I assume it means booted, but Ebay must have a reason for doing this (criminal intent etc) and if Paypal are saying they won't do anything till a week after payment is sent (by which time the money will have been banked and withdrawn) having info from ebay stating that this seller is potentially fraudulent (maybe his IP address has been used previously in a scam etc) maybe leverage for them to act now.
    Whatever the case I personally would be demanding to know what info ebay have that has led them to ban this person and why they waited until his auctions had finished and I had sent £400 to the guy before they did so.

    Also I'm not so sure all Paypals procedures are written in stone I got a refund for non delivery within 2 hours of filing a claim this week on a seller who's BIN listing had been removed subsequent to my purchase for an VERO infringement.
    I think there are people at paypal who handle these claims who actually use a little commonsense - but I may be wrong :+)

    Ebay do not discuss why users have been booted, data protection rules that out. It could be simple like a missing telephone number, or a problem with the sign up process.

    You can demand all you like, but ebay have legal protection on their side and do not have to give out details of other users bans. They will almost certainly refer back to their warnings for buyers about checking history of sellers before entering into a contract, and using the feedback which is there for that purpose.

    Fair enough I'd still try contacting ebay though gotta be worth a try you might get something out of them.
    btw what does NARUD stand for? Thanks Soo (hopefully I'll never be in a similar position looking for your help M8 fingers crossed :rotfl: )

    Thanks for all the replies. I have spoken to my cc company who advised me to call back in a couple of days if the item is not received. At this point they cannot halt the transaction. I have also logged a dispute with Paypal so hopefully that may help me get my money back. I have tried every way to contact the guy but he isn't responding to my e-mails or telephone calls. I don't know what else to do know except to sit tight and drink plenty of alcohol.

    Just one more question to try and calm the old nerves that are rapidly fraying. If this bloke is a crook and I don't receive my laptop, am I guaranteed my money back from the Credit Card company? I will sleep much easier if that is the case.

    Like you I paid for an item from ebay using a cc through paypal about 18 months ago.
    In my case the item (a watch) turned up but was a fake and broken. The guy refused to give me the money back £370.
    After filing a dispute with paypal and getting no where. I asked my cc company for a refund under the sale of goods act.
    Their response was this:
    They would not give a refund as I had not used my cc to buy the item. The CC had been used to pay paypal to provide a service to transact with a third party i.e. to transfer money.
    Therefore as paypal had performed this service they were not liable.

    Sorry this is so long but the meesage is clear - do not count on getting your money back from the CC company.
