    Fine if you don't want to repay its your own credit files which you will trash - forget about getting any credit for 6 years if they go for a CCJ.
    You don't think that these catalogue people have not had people like you before?
    They will know how to deal with you - as I have said if you cannot return the goods or transfer the debt onto a credit card or cheaper loan then you have to repay.
  • i know what you mean jones, but my point is this- unless they can prove i bought the goods on a finance agreement that i have subsequently failed to pay they can't go through courts, as when i request proof i owe them the money, they will have no proof. if they have no proof, they cannot pursue the debt

  • Here is the thing. Shop Direct are a bunch of sharks. Lying, cheating sharks. They do not send copies of CCA agreements out to be signed. My wife has an ongoing issue now going back 4 years over a debt that has been paid that SD registered a default notice against. There was never an agreement signed and despite repeated requests they can not provide any copies of the CCA (because guess why - there isn't one) yet they still have registered a default.

    Unethical, unprofessional and untrustworthy, that is Shop Direct.

    Have you not had a statement of account showing the transactions and the minimum payment required?

    I just think you are wasting energy on something you will not win but good luck to you.
  • we have had monthly bills and phonecalls we have responded with complaints etc but they go ignored.
    the situation is the same as this as far as i am concerned:
    jones, you owe me £1000 payable over the next year at £120 per month, you haven't paid so am taking you to court.

    what you going to do? pay it? or turn round and say ok, prove i owe you the money? i assume you say ok, prove i owe you the money,


    court says to me, mike, prove jones owes you the money as you claim.

    i say to court, sorry judge, can't, got no paperwork.

    court says well then get stuffed (or words to that effect).

    that is the same scenario we have here as far as i can see. if they can't prove we owe them money on the terms they say, they can't do a thing. they can send a statement that says i ordered 3000 tv's, 12 cookers and a trampoline, but if they can't prove it surely they can't demand payment for it?


    by the way, loved the match yesterday it was nice to see arsene losing it again (i assume you are a united fan)

    Everyday we see at least 2 threads like this one.
    Message to all those half witted chavs Pay your debts and learn.I would hazzard a guess you all have a brain and can think for yourselves, if so take some advice: If you want something then SAVE UP for it.............:mad: If you morons saved then you wouldn't be in a situation where your being shafted by finance companies,if indeed you are....

    Oh and if you don't like it then lump it !:rolleyes:
  • guys, please reread everything i have written. i am most certainly not a chav who deosnt want to pay my debt. i am however not willing to be railroaded by some crappy company into paying in a manner in which i have not agreed. i bought items on buy now pay later, i expected to buy now and pay later.

    if that company is trying to harass me and cause me lots of problems by demanding monthly payments at a very high interest rate, then yes, i am going to try and screw that company over, why shouldn't it. its a case of the little guy standing up to the big guy, not me not wanting to pay.

    if i had had no hassles i woul happily pay m agreements on th ebuy now pay later date, but under no circumstances does any company walk over me, and if that means i end up invoking a non enforcable agreement then so be it.

    i stressed to shop dirct that i would pay as i had arranged, and that if they continued to harass me i wouldnt pay at all, they ignored me so yes, if i can get one over on them, i will.


    i am not somebody who searches for loopholes to get out of things, i just want a fairer deal, basically, what i asked for in the first place.
