I'm just saying that I cant see in the guide where it explicitly states that someone can go back onto SDA from a period of employment. That doesnt mean it isnt there just that of what I read I didnt see it. I'll make no apologies for not reading the whole thing - its a fairly big guide.

I didnt see the point in mentioning in last night but when I checked the DMG relating to SDA the linking rules didnt seem to cater for WtW benficiaries the way IB and ESA do.

You may get SDA as soon as you become incapable of work. The following rules explain when this is allowed, but they are quite complicated. If you think they might apply to your case, ask your Jobcentre Plus office. Claims which are based on these rules are said to link with the earlier period of entitlement to SDA, Non-contributory Invalidity Pension (NCIP) or Housewives’ Non-contributory Invalidity Pension (HNCIP). You may get SDA without having to wait 28 weeks if:- you were getting SDA 8 weeks ago or less
- or you were getting SDA 52 weeks ago or less, went into work or training within 7 days after you last got it, and told your Jobcentre Plus office within 4 weeks that you had done so.
- or if you give up SDA to start work and you qualify for a disability element of Working Tax Credit, whether or not it is paid, or go on a training course, and you have to give up your job or stop training, and the first day of incapacity immediately follows your last day of training, and you make another claim within 2 years.

You will need to have been in this business for some time to remember that list of benefits though no wonder you will have beed told unable to claim when ringing up the BDC there are some pretty obscure rules hanging around from transitional benefits.0 -

i would put in a claim for ESA if your not eligiable they will pass it on to watever you are entitled to this happened to me i have been working for two years came out of work due to ill health (retired and im only 25) benefits agency told me income support no longer existed nor did incopacity and esa and jsa are the only ones that i could apply for. then they informed me that i wasnt entitled to esa and that the claim had been passed to incopacity they told me i was able to claim 3 weeks prior to me ending work then they told me that i could not claim because i hadnt paid enough ni contributions and that the claim was passed onto income support uner the 2 year linking rules if they denied you sda by saying this benefit did not exist any more but you claim esa and the pass it onto sda but they refuse saying that you did not claim early enough i would appeal the decision based on given wrong advice by them when you asked about the benefit. also esa claims over the phone told me i wasnt entitled to any other benefit including housing and council tax but low and behold i claimed separatly to the council and i now get that too. i rekon theyre told to say this to get you to go onto JSA and avoid paying you what your entitled to. i'm sure cab would be very beneficial to you and advise the same thing also the benefits adviser cannot make a decision on weather your entitled to a benefit that up to the descision makers you can apply for any benefit you like it's don to the descision makers to say yeh or neh!! insist on making the claim regardless of what the computers or the adviser says.0
