    Netabc's letter wa sent in after yours, so I'm sure your reply must be on the way.
    It will be horrid for anyone nearing their NCB who because of delays from picture in default and delays in the FSCS settling, claims it back (their NCB that it) and then only a short time later gets their compensation and gets it deducted:eek:. For people that have claimed their NCB whilst waiting for Picture to be declared in default it is very unfair and makes you wonder:rolleyes:. I think they should have a one for all here.

    Dear Mr S,

    Thank you for recent letter dated 17th November 2009 in response to my query regarding the NCB element of my compensation.

    However, whilst I have taken on board all that you have stated in this letter, I am still of the opinion that the calculation method used is unfair, unjust and unacceptable.

    Whilst I am NOT querying the actual figures used in order to calculate my compensation per se, I am in fact querying the actual methodology which you state is behind the calculation.

    I would like an explanation as to how it is possible therefore that your “Money paid In and Out system” is a fair and just way to calculate this figure as it seems blatantly apparent to me that I am being discriminated against solely because of the date of when my policy anniversary date was ie before you done your calculation.

    With this in mind and using your same methodology applied, I presume that you will be writing to all the other Picture customers that had received their NCB after you had done your compensation calculation to ask for this figure to be returned to yourselves. NO I THINK NOT!!!

    Furthermore, had my NCB not been due until November or December, for example, after my compensation was paid from you, I would still have received this from the Insurers, and obviously it would not have been deducted from my claim.


    I therefore feel I am being penalised by you because of the date my NCB was due and this is where your methodology falls down, as I am aware from various forums that there are many persons in exactly the same situation as myself and therefore this method is not fair to me nor the other persons that are in the same situation as having their anniversary prior to their compensation calculation.

    You have also mentioned in your letter that your rules are governed by the FSA, so therefore I presume that it is the FSA that I need to approach to voice my concerns further should the need arise.

    Should you require any further information in this matter, please do not hesitate to contact me.

    This is exactly our problem. We started our claim in November 2008 and we received a NCB at begining of October 2009 whilst waiting for our claim to processed. If we do receive a cheque I am sure this NCB will have been deducted. However if the claim had been processed before then, it wouldnt have been deducted and we would also have received it from insurers. Furthermore deducting our NCB has also delayed us receiving our compo (if indeed we are sucessfull!) as it has had to be returned to be recalculated and although we think this is the reason why no one at FSCS will confirm this.:mad:

    I think you have covered everything here barloo. and a very good letter, and don't forget I think their were others who had rcd NCB and not had it deducted. Although maybe you do not want to mention this!!!!
