    if you read Honey2's post on previous page, she says if the payment is late is one of the reasons they get out of paying your NCB.
    They will do anything to get out of paying it if they can.:mad::mad:

    Busbyh, I think most PPI missold is for bad advice if an advised sale.

    Told its compulsory, bad advice, told its a savings scheme, bad advice, not told of exclusions, bad advice. So most that the Ombudsman uphold is bad advice.

    So they are missold through bad advice. Have I got that right, but the insurance remains in force.:confused: But with case of Honey2's friend, it appears she was told everything she needed to know and was given all the options to cancel etc.

    Sounded to me as though the advisor knew it was a rip off and was ensuring she was giving her all the info in order to make her own choice.(or just doing her job properly)!!!!
    From the call, I don't think she could have told her anymore, do you?

    Yes,but my T&C's only mention Arrears,surely if they were late the account was not in arrears.Still to late now hope i just win my case!!

    I am a bit behind with honey2 friends case but will have a butchers later at it???


    If you look at the Ombudsman's cases upheld for PPI most of them are for bad advice but they are classed as "missold" and we are asked to be put back into the position as if we never had the PPI. I would see this as no different to what the FSCS is doing in that they are stating that you have been financially disadvantaged for being mis advised. If you are misadvised on a sale then again, I would think its missold???:confused::confused:

    I cannot understand how the FSCS can say in one verse, you have received bad advice and then in another, make a claim on your PPI if you need to. I think that if this is the case then FOS should also do this as a lot of cases they uphold are for bad advice and keep the policies in force just in case.:T

    i have just been looking through T & C of policy and it states
    "If you settle your loan early the policy will be automaatically cancelled and the refund(calculated as set out below) applied to our settlement figure."

    If cancelled after 12 mths 13% of premium, 24mths 10% doesn't state anything for less than 12mths other than the 30 days grace for full refund.

    I have checked policy and I can't even find where it states arrears never mind late payment. Will have to look again , I've looked at it so many times think I am going word blind:mad::mad:

    I'll bet they have deducted money from you for administration costs though!!!!!!

    On my FOS findings of the case that was resolved through them, it states that they don't believe enough information were given to us when they sold the loan/ppi, in order for us to have been given the option to have taken it or not, or even to be eligible for it (they did listen to the recordings), so still classed as mis sold, they also made a comment that they did not believe we understood the policy.

    honey2 has already received her NCB and the FSCS are aware of this and barloo has also just received £3000 plus.
    Honey sent all paperwork regarding payment of Ncb . From what I can see and read the FSCS just saying bad advice and as this is the case the Policy is still in force.
    Hopefully this means a lot more could have some welcome NCB cheques on the way to them.

    Honey has explained it well in one of her posts last night. As she said had she claimed e.g. 3 payments of £300 for sickness, she would have had this £900 deducted from her compensation, but this doesn't apply to the no claims bonus

    I have found it and it does state arrears, but don't late payments put you in arrears anyhow, even if it is only for a day or two:confused:
