Right spoke to FSCS still havent had anything from deloitte:mad::mad::mad: but found out that
we get a cheque and a letter together
cant be done by BACS
or email
Once deloitte send info to FSCS it can be completed straight awy and sent to us. He said there should be no delay in this.
I got quite upset and the nice man adviced me to ring deloitte to find out why it hadnt been sent through going to do that now.
Aww Di, so that means you have to ring Deloittes again then?
I would tell Deloittes that you have just been on the phone to the FSCS and they suggested that you ring these to find out about this, of why its not gone through to Deloittes?
This may shift them. The one and only "Dizzy Di"0 -
marshallka wrote: »Arh, just read this again. It seems the main reason why the judge ruled the debt unenforceable was that MBNA could not provide an agreement. He also ruled that they pay back the PPI with interest.
The main ground on which Judge Smart said Mrs Thorius's credit card debt was unrecoverable was because MBNA could not provide a copy of the original signed loan agreement, which is also a requirement by the Consumer Credit Act.
The Judge ordered the company either to repay Mrs Thorius's PPI premiums and interest, or the value of the commissions it had received which so far has been undisclosed.
The PPI premiums, which rose each month as the credit card debts increased, amounted to £2,500 over the time the card had been in use.
MBNA applied for leave to appeal, which was rejected, but it may now apply directly to a higher court for permission to appeal.
Or it may be able to appeal if it can find the original loan documentation.
Only when higher courts have decided the issue will the legal ramifications, and the effects on lender and borrowers, be clear.
If they can "find" the agreement then what happens????
It is however going to be argued by the looks of things.
Yeah I see.....I was thinking perhaps that the FSCS were delaying things as their decisions on PPI policies might have an impact on the entire loan agreement.
You know what government agencies are like:rolleyes:0 -

spoke to deloitte and they will be able to finalise it from their end this week, although he may need further info OMG I give up, but will ring me this aft. Anyway this should be finalised this week and then go back to the fscs. The fscs told me earlier that it will then be a matter of sighning it off and sending cheque. Just rung them again and was told this time that it will take two or three days to come from deloitte then it has to go to variuos departments before coming to me. Again no timescale and woulnt give me one at all no matter how I pushed, but if what I have been told is true, finalised this week then it shouldnt be much longer, hopefully. I was told I could ring anytime and to call back in a week to see what progress had been made. I dont know how I feel about all this really need another fag:D0

Dialysis, I would say to deloitte that the FSCS have asked that you CONFIRM the amount of the cheque with them as you are trying to sort the roof over your head.
EDITED - TOO late0 -

Some answers then.
Blimey Di you have been going round in circles with this, I'm getting dizzy just reading them .
Your doing the right thing though Di, they need to need to be kept on at, and should realise your situation by now, so lets hope you will have this resolved sooner.;)The one and only "Dizzy Di"0 -
