T-mobile: "of course you can't use a phone in the rain"

    I don't doubt that the phone has been damaged by water ingress. The argument that I'll be pursuing is that a phone that can't survive a rain shower - especially when reasonable care was taken with it - isn't of satisfactory quality and should be repaired, refunded or replaced under the Sale of Goods Act.

    I had exactly the same problem with T Mobile once. I dropped my phone about a foot and it stopped working. I sent it off to be fixed (obviously didn't tell them I had dropped it just said it had stopped working) and they sent it back unrepaired and said it was water damage. The phone had been nowhere near water at all (the reason it was broke was that I dropped it!)

    They sent me a picture of the 'damage' on the inside of the phone but there was no suggestion or proof that that was even a picture of my phone it could have been any picture or even a generic one they send.

    Pardon the pun, but your story is a bit leaky.

    First you say she DIDNT use it in the rain, then you say she DID, but you're unhappy that the phone didn't survive it.

    So you're admitting that the manual DID warn you about it, but you chose not to heed that warning? Personally, I'd say that anywhere it's raining is a "wet location".

    To be honest, this whole thing sounds like a combination of clutching at straws and sour grapes to me.

  • exsqueeze me...... tmobile do not directly repair handsets. they are sent off to an independant repair centre where, as they *tmobile*are not the technicians and cannot dispute the decision of the outcome. ..they meerely go by the technicians outcome.. if a handset is deemed water damaged them the customer should be offered a contract extansion.any dispute should be raised with sbe......(repair company)

  • the contract extention will be offered if the handset is put on the BER (Beyond Economical Repair) spreadsheet. the customer is then provided with a phone of there choice (either free of charge or if there is any additional charges for choice of handset they have opted for) and the current contract is extended by 12mths.

    My advise - take insurance, or have insurance set up to protect your handsets.

    Surely it's the handbag manufacturer/seller that should be pursued, not the phone operator? Get the money for the phone repair from them.
