    my brothers phone stopped working due to moisture damage but he admits he regularly took the phone into the bathroom

    Also, it's not really fraud. I didn't lie about when it got dropped in the toilet. I just got the insurance and called them about it at a later date. They never asked WHEN it got dropped, they just said a replacement was on the way & to send back my broken one.

    Well if consumer does it, its fraud and if your insurance does it, its their policy.
    Have you ever wondered that if you don't claim on your insurance, money's down the drain. If you do which is whats it for, you are a high risk!!

    Fraud according to me is something totally dependent on your circumstances and what your conscience says( spellings)
    Have a look at orange cancellation thread. how many ppl are cancelling just coz they wanted at some point in past...... maybe with some other network. Whats they doing now is REVENGE.........

  • This is where I've come to in my thinking on this:
    • [FONT=Arial, sans-serif]All mobile phone users will from time to time be caught in heavy rain. A phone that must be left indoors on days where rain seems possible is useless for its primary purpose.[/FONT]
    • [FONT=Arial, sans-serif]In 15 years of mobile phone use, I have never seen a phone damaged by rain.[/FONT]
    • [FONT=Arial, sans-serif]T-mobile's sales staff made me aware of various possible accessories when I purchased my handset. If it were generally necessary to protect phones from rain showers, I am sure that they would attempt to monetise this need by suggesting weatherproof cases to customers.[/FONT]
    • [FONT=Arial, sans-serif]In attempting to sell me insurance, their sales staff warned me about many bad things that could happen to my phone. Getting caught in a rain shower wasn't one of them, presumably because most phones are built to withstand brief exposure to rain.[/FONT]
    • [FONT=Arial, sans-serif]Four members of our family carried phones on the day when the G1 failed. The others – an HTC Touch Pro 2, an LG KS360 and a 3 mobile Skype Phone all survived, despite having been exposed to much more rain than G1.[/FONT]
    • [FONT=Arial, sans-serif]One of the staff in their local store was aware that the design of the G1 was particularly vulnerable to water ingress. No notification of this was given to me at any time before the damage took place; had I been aware of the vulnerability, I would have treated the phone differently or purchased a different model.[/FONT]
    • [FONT=Arial, sans-serif]T-mobile's website's search facility returns no warnings about protecting phones in the rain.[/FONT]
    • [FONT=Arial, sans-serif]The sales literature for the G1 does not warn customers of the risks of potential damage from rain showers.[/FONT]
    • [FONT=Arial, sans-serif]The G1's manual contains no warning about potential rain damage. The nearest instruction is found in the section “General Precautions”, where the advice “Never use the product in a wet location” is given. Given that mobile phones are intended to be used outdoors, this appears to relate to bathrooms, saunas, swimming pools, etc.[/FONT]
    [FONT=Arial, sans-serif]I conclude that most mobile phones are built to withstand rain showers, and that T-mobile therefore take no steps to warn customers of the dangers of rain damage. The G1 appears to be unusually susceptible to moisture, but they failed to warn me of that fact when I purchased it. In the absence of any special instructions, I treated my G1 in the same way as a normal phone and this caused it to fail. It was therefore not of reasonable quality and was not fit for the purpose for which it was sold.[/FONT]

    Well it still works - after a fashion, keys are jamming, not working and just doing weird things altogether

    Just in case your wondering, T-Mobile don't make the G1 - it's actually made by HTC and they call it the Dream.

    I will have to go aginst the grain here and say it's really the persons fault for getting it wet. I wouldn't pull out my phone if it was raining and i didn't have my brolly with me.

    Electronics + water = BAAAAD idea

    If it's more than spitting then it stays frimly in my pocket until i'm inside somewhere

    you should read the first post properly before posting... the OP says the phone stayed IN THE BAG at all times. therefore, they DIDN'T "pull out their phone" as you so eloquently put it.
