How hard is it to get a job having misconduct against you?

    so what u are saying mrs tine that anybody who comes to your interview with gross misconduct u wouldnt even listen to the reason it happened.

    like in my case i was provocked into swearing at him twice after i have put in 22 years service.

    If I had another 9 candidates all equally qualified? Nope... not a chance. If I had 1 well qualified candidate and 9 much less qualified then I'd ask for an explanation and permission to contact the previous employer for details on the incident before hiring a well qualified candidate over 9 less qualified but clean records...

    Edit to add - even 22 years of good service wouldn't matter... my team was working in a very stressful field and I wouldn't have been able to take the risk of someone loosing their temper in there because it would have been WW3... If you've lost it once then you can loose it again and I would think be more likely to do so.
    I now do a lot of face to face client work (when not on maternity leave lol) and although provoked regularly I CANNOT loose my temper - EVER! If I did I'd loose the company at worst a £1mil profit a month... I'd be unemployable!

    don't be daft! seriously, if every person in the country who had been sacked never got work again, there would be a lot more unemployed. I know people who have been sacked who have got other jobs. Anyway, it might not come to that :money:

    If you do get the sack you could take them to an industrial tribunal for unfair dismissal, looking at your other thread this does not seem to justify gross misconduct and after 22 years of good service I'm sure a tribunal would say you should have been given a final warning instead!

    I think the thing to take away from this debate is that every company is different. Some employers view a gross misconduct as an automatic dealbreaker, whicle others would treat it as a case-by-case basis.

    Which means I wouldn't worry TOO much about it - it'll be harder, but it doesn't sound impossible. You just need to be better than the other candidates during the selection process in order to stand out and make them want you more than those without the gross misconduct!

    I have jumped over from your other thread,

    Gross Misconduct for threatening behavour, would be a very difficult one to dig out from, and prospective employer would judge you on your facts and if this came out the door would close.

    Hence the reason you do not give up hope on the current 22yr job,

    have you phoned acas and had some advice?

    Are the people in question your peers?

    Lay all the facts down to acas and if all is lost resign prior to a disciplinary hearing (But this is way down the line and a last resort!)
