    You have spoken to your ex and he says he cant pay thats all you can do down that road.

    Next action is to look at the paperwork regarding his new nil assessement, can I suggest you post his income and housing costs number of natural children and i can do a quick calculation to see if his protected income is stopping payments. If his income has dropped below what you think could not maintain his lifestyle then you need to go for a departure dirction on those grounds. While you doing a departure also go for his partner contribution towards housing costs, if she is not working then she has nothing to worry about.

    I have no advice for you OP, sorry, but I am shocked that he does not have to pay any maintenance for his first child because he has had another?

    How can one child be more important than the next. The csa is even more of a joke if this is the norm!

    I hope you sort it out, Maybe you should do as another poster suggested and close the case then re-apply under the new rules.

    Ok..here goes. If anyone can explain this in simple terms then it will be gratefully appreciated!

    following a change to your child maintneance, we have worked out that £0.00 a week must be paid from 21/07/09

    Maintenance needed £117.71

    This includes:
    -total child allowances £56.11
    -carer allowance £64.30
    -premiums £17.30
    less Child Benefit £20.00

    Your income

    We have decided that you have no income that we can include in the assesment.

    This is because you receive:
    -Working Tax Credit

    The other parents income (weekly)

    Income after deductions £308.28

    Exempt income £241.10
    This includes:
    -housing costs £103.39
    -travel to work costs £0.00
    -property/capital settlement allowance £0.00

    Income included in the assesment £67.18
    (income after deductions less exempt income)

    Maintenance assesment before considering protected income

    Maintenance assessment amount £33.59

    Considering if the other parent can afford to pay this maintenance assessment in full

    No child maintenance will be paid if the assessment amount is less than the minimum amount the child support regulations say a person must pay, and the person responsible for paying meets certain conditions. The leasflet in CSA 2024 explins these conditions.
    The assessment amount to be paid has been reduced because there is not enough income to pay the maintenance assessment in full. The amount to be paid is either 30% of the income after deductions or the difference between the disposable and protected income, whichever is less.

    I know, I don't understand it either. I feel bad for disputing their decision and don't want to seem like a money grabber because I'm not atall. But I do think all men (and women) should face responsibilities and pay towards their childrens upbringing, wether they have 2 children or 10! I understand he has a step daughter and that he's going to be supporting her in way but that doesn't mean he shouldn't have to support his own child. It;s just so frustrating! Thankyou for posting, the support on this site is amazing.

    You are not money grabbing at all. He should have to provide for the upkeep of his children. He should be supporting the child he had with you as much as the one he has just had. Don't feel bad for fighting for what your child needs and imo is entitled to. I just hope the csa does the right thing and makes sure both his children are provided for!

    Hi, thanks! That's what I want too. I have no problem atall with it being reduced, I expect that ,but to go from £54 pw to nothing seems daft. I don't why she should miss out, especially as both her parents are working.
