    Yes, the customer has to have some diligence but should always be in a position to assume a equipment is safe. There is a difference between inconvenience (which is what the OP accepted) and unsafe (which is what the wheelchair ultimately proved to be).

    Think you missed the bit where staff knew it was broken..."they" highlighed below refers to Tesco.

    If it went to court, do you not think they would be asked if they wer aware of the condition of the chair? of course they would!
    I'm not saying it wasn't terrible what happened and that Tesco don't hold some responsibility, but they made an informed choice to still use the chair in full knowledge that it was not completely fit for purpose.
    That would be asked of Tesco first and they did know and were therefore negligent. There may be some mitigation because the customer chose to proceed but it is down to Tesco to ensure that their wheelchair is safe and if they think it isn't then don't offer it for use - Tesco failed to do this.

    Pushing an elderly relative in a wheelchair does not make you their guardian, nor did the OP mention this was the case. To be a guardian in this context requires power of attorney which comes from a court order, more specifically:

    Personal Welfare LPA
    A Personal Welfare LPA allows you to choose someone to make decisions about your healthcare and welfare. This includes decisions to refuse or consent to treatment on your behalf and deciding where you live. These decisions can only be taken on your behalf when the LPA is registered and you lack the capacity to make the decisions yourself.

    I agree.

    When you kill someone with intent it's murder. If you kill someone by your unintentional actions it is manslughter. Therefore if you "attempt" manslaughter it become murder because there is intent.
