No it wouldn't go to Court.
Tesco's duty is to provide a reasonably safe environment. They didn't. They are liable. If they could should that it was unreasonable for someone, such as the injured party, to sit in the chair, there may be some con neg.
Open and shut case though.

open and shut case, definately not. The injured party knowingly sat in a chair that was faulty, she could have refused the chair.

It just wouldn't. It would be a relatively small claim, and it would not be in Tesco's interest, from a financial point of view, to vigorously defend it. They would settle in a shot. OK, then may argue some contrib, but they would be primarily liable.0 -

No but I can speak from having had considerable experience in this sort of thing. It is just not worth the hassle of defending a claim worth less than £1k.0
