"I read in the paper today that the mother of murdered Scarlett Kelling once served one year in jail after attacking a man with a knife. One thing puzzled me though. It says "Hippy Fiona, then 18, and a female pal were accused of attempted murder. But the charge was reduced to attempted manslaughter after the 1983 trial and Fiona served one year of a three year sentence. "

there is sucha thing as attempted manslaughter but is a rarely used term

Absolutely no such thing as attempted manslaughter. Ridiculous.

No it wouldn't go to Court.

Tesco's duty is to provide a reasonably safe environment. They didn't. They are liable. If they could should that it was unreasonable for someone, such as the injured party, to sit in the chair, there may be some con neg.

    Open and shut case though.

    are you for real?
open and shut case, definately not. The injured party knowingly sat in a chair that was faulty, she could have refused the chair.
Why wouldn't it go to court?

    Erm, yes there is

    Wikipedia
On 24 August 2004 Matti Nykänen was arrested on suspicion of attempted manslaughter after the stabbing of a family friend. He was found guilty of aggravated assault and sentenced to a 26-month jail term on 27 October 2004. As a first-timer, he was released from jail on 21 September 2005 While on probation, he was re-arrested four days later for abusing his current life companion, Mervi Tapola. Nykänen was convicted again for four months on 16 March 2006

    That's in Finland.

It could also apply in the Isle of Man and the USA too, but I'm 99.9% certain that this claim would proceed under English law.

It just wouldn't. It would be a relatively small claim, and it would not be in Tesco's interest, from a financial point of view, to vigorously defend it. They would settle in a shot. OK, then may argue some contrib, but they would be primarily liable.

    AND?
They said there was no such thing as attempted manslaughter, I'm merely
pointing out that yes there is!

You can't possibly know that, you are presuming that will be the case.
doesn't make you any more right than anyone else!!
Unless you are the legal spokesperson for Tesco?

Maybe my experience tells me that that would be the case?

No but I can speak from having had considerable experience in this sort of thing. It is just not worth the hassle of defending a claim worth less than £1k.
