If it went to court, do you not think they would be asked if they wer aware of the condition of the chair? of course they would!
I'm not saying it wasn't terrible what happened and that Tesco don't hold some responsibility, but they made an informed choice to still use the chair in full knowledge that it was not completely fit for purpose.

More to the point, Tesco refused the use of the 'safe' chair due to their own security reasons, effectively leaving the op with no choice other than not to enter the shop.

is that not a choice then?

If this goes to court, I`ll pay the compensation myself
It`s not in the interest of neither party.

Besides the op has probably accepted an offer from Tesco already ...my guess £250, a bunch of flowers and a card.

Just trying to drag this vaguely back onto point...

Firstly I must say, I feel very sorry for OP's gran. And I also hope that she makes a speedy and full recovery.

I must make it clear that I am not a huge fan of 'no win no fee' type companies. I feel that they encourage the already over litigious society in which we already live where people use unfortunate situations to take people for whatever they can.

I do however feel that there ARE circumstances in which people do deserve suitable recompense for them having come to harm at no fault of their own. I think the situation described by the OP is just such an example.

However, I must ask...has anyone considered what the OP's gran would want in the situation. At the end of the day, she is the one who has come to harm. I realise that this may temporarily mean having to relive this most awful of situations, but it is ultimately her life and, as such, her choice.

Would she want to pursue a full on legal claim? Or would she be happier just raising the concern more amicably through the Tesco complaints procedure (and possibly/probably gaining in some way through this)?

I realise that harm has occurred and, as I said before, that something should be done. However, I am just worried that the person who has really been hurt here has been forgotten.
Just started comping - 1/12/08 - keep your fingers crossed!

I think you are probably right, it just makes me wonder what the world is coming to when someone's Nan is injured and the very first thing on her Grandsons mind was "how much can we get out of this"
He posted the thread the very same day it happened and admitted he was considering going to one of those awful compensation firms.
Vulgar is the word that springs to mind

No I am not...I am just replying to your post where you insulted a learned contributor...is that a problem?
  • I am simply bowing down to your superior intelect in this subject :A

Judging from your posts on this thread you're going to have to bow down to 99.999% of the forum members (including student phil - where's he gone to?). The comment on attempted manslaughter is pure comedy.
