3 mobile cancellation within 7 days

Hi,

Yesterday I signed up to a 18 month contract with the 3 network. However upon getting home the reception I received was not the best and after reading a few reviews on the net it appears this is a common problem. My question is as I bought it in sotre what are my rights on returning this product? Can I cancel my contract as I only bought it yesterday?

    Three do have a cooling off period of 14 days, although from memory I think if you use the phone for calls or texts then you can't return.

    I have not used the phone except to turn it on and that is when I noticed the signal was not good. So I hav enot changed anything however when I phoned up the branch they told me that they do not have a 14 day return policy if you buy instore it only counts if you buy over the net. Have they definately got the 14 day return policy for phones bought in store as well? If not does anybody know my chances of getting the contract cancelled?

    If you've even set the time and date they won't take it back saying you've 'personalized' the handset, beware. . .

    14 day cooling off only applies to 'remote' orders, eg net, phone. Bought instore it does not apply.
    No free lunch, and no free laptop ;)

    No problem,

    The signal flicks between 1 bar and no signal. Spending most of the time that it was on at no signal. I have not set the time or anything on it yet so they can't use this as an excuse. All that I have done so far is turn the phone on.

    Our Returns Policy:
    If you're a new customer who purchased your mobile via three.co.uk or from our own telesales team and for some reason you change your mind, provided you have not used your mobile, you can return it within 14 days of receipt. You'll also have to return the original boxed accessories and documentation 'as new'.

    This policy doesn't apply:
    • to new customers who did not purchase their mobile via 3's telesales team or via three.co.uk, or
    • to new customers who purchased their mobile via 3's telesales team or via three.co.uk who have used their mobile (this means that you may not personalise your mobile in any way, or use any of the 3 Services, or take photos or videos or load any data onto the mobile), or.
    • to existing customers who choose (where allowed by 3) to upgrade their mobile.

    If you do not receive sufficient service at your home address then u have 14days to return the product to the store due to coverage. You will need to also bring back the box, all items that came with the handset and all paperwork you were given.

    Cheers for the advice. I'm not sure why I'm getting a poor signal as on the coverage map I should be getting all coverage! Oh well I'll take it back today and see what they say.

    I have the same problem only slightly more complicated.
    I purchased a 3 contract of 18 months at £15 per month on 6 July for my son's birthday, when I set the phone up for him it stated emergency calls only but I was told in the Carphone Warehouse that it may take up to 72 hours to connect to the network so I thought nothing off it. Unfortunately I went away to Spain for 2 weeks and came back on 24 July to find the phone still stating emerg calls only.
    I had by this stage received correspondence from 3 so rang the number.
    I was told that they was no coverage in my area at all and to go back to the Carphone Warehouse shop that I bought the phone from which I did.
    They told me that it is nothing to do with them but with 3, so the manager there rang 3 and I was put on to them.
    One hour later we left the store no further on, I was told I could pay £232 to get out of the contract!
    3 asked me was there nobody else that could use the phone! There is no signal within a 15 mile radius of our house and the phone was for my son who goes to school 6 miles away so really it is useless.
    I am now left with a phone to pay for 18 months which is totally of no use to me.
    Does anyone have any advice as I have to get on the ball with this again today, I was going to get on to Carphone Ware house head office because at the end of the day I have entered into a contract with them for a product that doesnt work for me, they got all my details at the point of sale so knew the area the phone was going to be used in.

    Oh forgot to say as I went on holiday I was outside the 14 day exchange but when he checked there is no return or exchange on 3 anyway so it wouldnt have mattered even if I had off went back the next day.
