    So according to the FSA the banks should cancel a CPA if the customer requests it. About time some common sense was used by the banks.

    Indeed about time, it has only been enshrined in law since Nov 2009 and the banks are only bothering to do something about it now. They always had the facility to fix this, it just involved, time, money, and staff training who they seem to have misled as well as meer53 as clearly shown in past posts.

    Comments about Visa and Mastercard chargeback rules are not relevant here, it is the banks problem and it always was the banks problem.

    Incredible how most of the banks are still getting it wrong 2-3 years down the line. Even the card payments spokesperson said each bank has it's only policy and when Paul said policy can't over-ride law the spokesperson said yes.

    What I also find interesting, is all of the people sticking up for the banks in this whole mess (across various CPA threads), that is it is nothing to do with the banks (it is anyone but their fault) and it is all between the customer and retailer.

    Some people take what they are told by their bank at face value as if they are acting in their best interests, and they take what they read on this forum without asking enough questions about who is posting what.

    This can lead them to months of trouble they would never have had if they just knew their rights and the law (and in this case it is not exactly new!).

    I sometimes think this board needs a moderator and this subject is one example of why, althought I hope someone does not choose to use that to get off of the topic of banks responsbilities and change the subject away because they have been exposed (for want of a better word)!!!!

    Hi all, I recently started an online home study course at a cost of £355. What attracted me was the option of paying by DD. when I enrolled over the phone I was told I had to pay a small deposit by DC which I did. I was then told that further payments would be taken by DD monthly. I was even asked what day of the month I'd like them to take the DD from my bank account. I then received an invoice in the post which states quite clearly that I would be paying by DD. I also have a copy of the terms and cons about DD. Their website offers the option of either paying in full or monthly installments by DD. Ive been keeping an eye on the dd's on my online bank account and, since I joined 8 weeks ago there has been no sign of a DD for the home study course. On one occasion I phoned the company and was told not to worry and that the DD was in place as far as they were concerned. 2 days ago I got a letter from them saying my bank had declined the payment. On that letter it again mentions DD. Apart from when I paid the initial deposit by DC I have not once had any suggestion that payments would be taken by Debit Card (recurring charges). If there had been any suggestion that I would have to pay this way I would have ran a mile because of the very nature of DC payments. If I'm right and it turns out they are actually not charging me by DD but by DC instead, have they acted illegally and what can I do about it? Ie: cancelling payments.
  • My husband registered with a company called credit expert a couple of years ago in order to monitor his credit status. Unknowingly, he set up a r/p. For the last 2 years he has tried without success to cancel the 7.99 pm payments. He has emailed and phoned credit expert and phoned his bank. Credit expert have either ignored his requests or bombarded him with the benefits of staying with them and the bank have told him that they are unable to cancel this type of payment and advised him to go to the company direct. Thank you for the information. We are now going to attempt to get a refund as the only solution seemed to be that his debit card was due to expire but if he can claim back payments as well, he will be over the moon. I will keep you posted
