    What they appear to have told you fits the norm for CPAs that customers have either knowingly established or unwittingly agreed to with a company they have had a payment transaction with (i.e. simply disputed transactions), with them cancelling the cards just as a standard procedure (I could be wrong but I don't think cancelling the card guarantees that further CPA transactions won't be processed).

    The situation you describe (i.e. no previous dealing and no payments - single or CPA - to the company) on the face of it appears to be closer to fraud, which I would expect the bank to treat rather differently to protect either you or the bank from further loss (although perhaps the low value has a bearing on the bank's decision). If you truly believe they are fraudulent transactions I would make sure the bank are aware that you are talking about fraud rather than just disputing the transactions.

    Hello All,

    Have just had my car insurance with the jokers at Kwik Fit cancelled not too big a deal as I firmly believe they deliberately mis-sold me my policy. I'll post the details in the car insurance forum but my question relates to a final payment they want from me.

    I had elected to pay over ten months with an initial deposit being taken from my debit card. A few weeks ago the company I work for moved over to monthly payments which meant that there would be no funds to pay KF's DD so I cancelled it.

    As I was in Germany on tour at the time I could not contact KF until I returned some ten days after the DD's due date. When I did, I rang them and discovered that they had cancelled my policy. I politely offered the missed payment and an agreement to set up a new DD if they could reinstate the policy.

    They said that they couldn't/wouldn't do that and furthermore not only did they want the missed payment for November but a further 100 pounds in cancellation fees! Apparently as I had been sold numerous "bolt ons" each of them incurred a cancellation fee too!

    Whilst I understand that they may be entitled to claim for the missed DD I find their cancellation charges unacceptable and told them so.. Basically their attitude was we don't care! I was futher told that they have my debit card details and will collect all due monies from this account when they want to, and whether I want them to or not!

    So my question is this, as a deposit (and thats the only time I gave my card details) is quite ostensibly a one time payment can they do that ? And would there be any point in me cancelling/losing my card?

    From what I've read here there seems to be a difference between an RPA and a one off payment is that right?

    If you cancel a DD and you owe a company money they will use whatever details they hold on their records to try to debit you.(ie, your debit card details) This will be in your contract terms and conditions somewhere, along with their policy on cancellation and the fees they can charge. You need to read these before you start arguing with them.
  • I thought that if you reported your card as Lost/Stolen then a new card was generated with a new number and any recurring card payments could not be taken from the stopped card.

    I had two recurring payments - one I wanted to stop one that I didn't. I reported my card as lost/stolen even though I hadnt lost it or it had been stolen. Sure enough both companies contacted me to say they were unable to gain payment.

    So surely reporting your card as lost/stolen is the way to go to stop these.

    Yes but is this an "old" card that is simply cancelled and closed and not reported as "Lost and Stolen". So why were the companies unable to take my payment when I reported the card as Lost and Stolen?

    I thought a card stopped as Lost & Stolen ANY further payments could not be taken from it?

    Thought I'd give an update on the KF situation, by a happy twist of fate I did 'lose' my card and reported it to my bank.

    A new card was issued with different numbers etc, and KF were NOT able to take any payment. From a little bit of research I've formed the opinion that its the 3 digit security code on the back thats the important bit, when that changes its a clean slate.

    Of course KF have written to me basically throwing thier toys out of the pram! lol I will of course pay them what I owe but under my terms not theirs.

    I signed up to movielush.com which claimed you could watch up to 3000 movies for a one time 5 day payment of 50p which I had to enter my card details to process the payment, when my account was created I discovered the movies were all low budget films that weren't worth watching, after a couple of months they took a further £24.95 out of my bank account without it being authorised which I didn't bother bringing up the problem, they have now recently 6 months later took a further £24.95 out of my bank can anyone tell me if I can Barr the payment coming out of my bank as its an American based company and has had loads of complaints on the internet in the past year or so and I'm surprised it hasn't been shut down yet or they have changed their details as to what specific movies they offer, as I'm sure many others have suffered the same problem, any help with this would be great, thanks.

    Did you read the terms and conditions regarding recurring payments ? Theres quite a lot on there, seems as though you managed to sign yourself up by accident. Cancel the agreement as per their T & C's then if they debit you again you can ask your card issuer to take it up for you. Theres a bit on there about promotional offers too, did you sign up to one of these ?
  • I booked with a hotel in amsterdam a few weeks ago. They pre authorised my card for £74 without my knowledge. Now although they havent taken the money from my account, they might as well have done as I cant access this money. They said they would return it in a few days, they havent. Ive now cancelled my booking with them and as I am within the cancellation policy I am entitled to my money back straight away.... I have an email that says as much from the manager. She says she unblocked the money last tuesday... six working days ago but it's still not ahowing as returned in my account. Has anyone had experience of this? The bank says there is nothing they can do and I have to take it up with the hotel, which I have, four times. They are really rude and unhelpful and Im not getting anywhere. Yes, they have said it's being returned but like Ive said, Ive seen no evidence of this yet and am still missing this money. What can I do if the worst comes to the worst and they keep holding these funds in definitely?
