These additional fees they keep adding to your account aren't legal and you are not liable for them. Just because they keep adding costs doesn't mean you owe them!
I'm not even acknoleging their emails. They can take me to court if they can find me.0 -
In 2008 /2009 I was dealing with BANK SMART reclaiming credit card charges and a large bank charge. The bank charge fell through and so did some of the credit cards, but I did get some money back and paid all the charges made by Bank Smart. Now two years later they are saying I owe approx £200 in charges of several of the accounts that are showing closed on my account, they are threatening to increase the charges if I dont pay. I havent heard from them, I havent received any emails so how can they now two years on demand money. I think they are conning me. What can I do. I have emailed back many times over the last few weeks but am getting nowhere.0

I too am being hounded two years since I dealt with BS for reclaiming charges. Heard nothing from them for two years no invoices or emails now they want £200, same deal as previous people. What can we do, is there any one handling all these complaints against BS. The constant threats of increase charges are getting me down.0

all you on here email the ministery of Justice and show them the information. do not sit on it waiting on this like i did in the beginning. but do research, email and get intouch with who every whether media, cab or moj but also include BS in the emails.0

I have also had the same problem. I am not responding to either theire e mails or letters. They are not worth my time or effort. I have now had a letter from a debt collector and I am ignoring that as well. Let them take me to court. I owe them nothing and am not worried in the slightest. They are banking on people worrying about it and paying up.0

Spot on. We can't go round paying every cowboy who turns up saying we owe them money just cause they say so. Ignore these cowboys.0 -

We have the same problem i.e. we put in several claims and they posted on the account all the things they were doing and then about a year after the start they turn around saying they had failed in their claim and we have to pay over £1000 in fees but after a few emails I got them to see that they have no right to charge these fees and the emailed me saying that I was right and they would not be charging me and that they would update me on the other claim and why some failed and that was 4 months ago and they have not got back to me yet. I also don’t actively thing they did anything just said that they were doing this and that and actually doing nothing. They also charged over £3000 at the start which they said would be refundable if the case failed. I have email them again demanding the get in contact with me and I’m waiting until the 2nd of Feb before I take action and report them to the Legal Ombudsman and Solicitors Regulation Authority and I would like anyone else that has had problems with Bs to report them to and we can hopefully get them investigated. Get back to me if you would like to join me.

The Solicitors Regulation Authority does not regulate them, the Ministry of Justice does because they are not solicitors.
For the same reason, the Legal Ombudsman has no jurisdiction.0 -
I'm with you Donaldosn. Bank Smart (terrible company) are applying for a Consumer Credit Licence. That means they are trying to get into the Debt Advice industry and rip-off even more vulnerable clients than they do already.
I run a company that has had the mis-fortune to have used these cowboys to refer clients to - clients who were looking to reclaim PPI and check for unenforceability which is what BS brag that they specialise in.
We too were duped by these robbing idiots and we had to work very hard not to lose many of our clients. We have paid many of Bank Smart's 'Invoices' on behalf of our worried clients due to their bullying collection tactics to recover fees that they seem to make up as they go along. Bank Smart complaints account for 100% of our customer complaints over the last 2 years (we stopped using them a year ago bt the complaints continue).
I am building a portfolio of evidence of non-compliance, errors, unprofessionalism, shoody work, breaches of contract, seemingly 'dreamed up' charges - you name it we are recording it - in order to present to the MOJ and Trading Standards.
However, this company can only be stopped if they are attacked from all angles - therefore I implore anyone that has the mis-fortune to have ever dealt with these crooks to either do the same and send to MOJ, TS (and also OFT by the looks of it) or send them to me and I will add to our portfolio. Or - maybe I'll send all my findings to Donaldosn.
I'm not sure if complaining to MOJ or TS will change much tbh - therefore I shall be posting everywhere I can the message to other potential victims - IF YOU WANT TO BE RIPPED OFF, IF YOU WANT SHODDY SERVICE, IF YOU WANT TO USE A BUNCH OF SCUM TO DO YOUR PPI CLAIMS, USE BANKSMART. ABSOLUTE THIEVES.
BTW - anyone being chased aggressively for outstanding invoices - many of our clients pay them 1 measly pound a month and they don't seem to be taking any further action such as CCJ or charging order... Although if you don't acknowledge you owe them anything I can understand you not wanting to give them zip0 -
I instructed Bank Smart in November 2010 to look at my Halifax Credit Card for unenforceability.
I have never come across a company like this before, they do not reply to emails, and they have no telephone contact either.
They gave me an address in Truro, Cornwall to send paperwork to.
I sent to this address the following:
1. Copy of signed agreement sent in January 2011 recorded delivery - signed at this address
2. 6 years worth of credit card statements sent in February 2011 - next day delivery - signed for at the address
3. Further paperwork sent from Halifax regarding agreement T & C's - sent next day delivery - end of February 2011 - signed for at that address
To cut a long story short, Bank Smart have now claimed NEVER to have received any such paperwork from me and they claimed the signatures on the recorded delivery slips don't match any member of their staff!!
I telephoned the Claims Regulation Department at the Ministry of Justice who have informed me that Bank Smart are under investigation over a number of matters!!
I then received an email from them saying that they will not charge me any fees - I have kept this by the way!!
My advice - DONT USE BANK SMART!!0
