What everyone is forgetting is that we are dealing with the school run. Normal driving rules and common sense do not apply under these conditions. I have worked in a school and witnessed the chaos by parents...dodgems at the fairground comes to mind0

This is going on a bit now, I don't think there will be any agreement, and the OP has probably left by now.
Regardless of blame, thinking about it, injury has also been caused, perhaps trivial, perhaps not, as the OP's wife was hit by the door and knocked over. As it is not just vehicle damage, the accident is probably reportable, and the OP's wife should do it asap, and should get a check up by her GP, to cover the paperwork in the insurance claim later on.

I'm afraid it is now becoming surreal. A moving car hits a stationary, parked car, and you are now argueing the the parked car is at fault and should be liable. I'll bow out now, as I can't think of any logical answer to that one.
If you take the trouble to read before typing Mikey, I was suggesting that the other driver has given a different story to the OP, the only thing I can sumise is that he/she is suggesting the door was opened or swung wider as he was passing?

And that is the larger issue some of us are aware of, and are trying to point out to others.
I do feel sorry that the OP has been dragged along by this one, as said there is an underlying larger issue, but it's the age old story of only hearing one version of events in this case

there already enough advice given the whole thing is that you must consult you insurer or some personal injury attorney.0

OK, just to keep you updated. The people who hit our car (and my wife!) wanted to push this through the insurance. However, we have now received word from our solicitor that they ahve admitted liability.

Good news Ivory.
Sometimes people on here are quick to jump onto the crazy school run mum (which is entirely another topic) and ignore the facts and/or common sense.
If someone opens their car door suddenly into traffic or a passing cyclist then yes they are negligent. What happened here was someone trying to load a car with their sprog with the car door already open. If this occurs then other motorists have to make way around the obstruction. Same goes if a van was being unloaded with goods from the side door, you can't expect the driver and goods to disappear from the roadside in a nano-second if a car passes.The man without a signature.0 -
