No legally they cannot chase you. Sometimes it will not stop them trying though. But if your debts are included in your BR, they have no legal right whatsoever.0

I`d never heard of Marlin!!
...but recognise the tactics. Luckily now I can `recognise` them but in the early days the DCAs would reduce me to tears & sleepless nights on a regular basis.
Personally I hold very little respect for these Companies...they buy wholesale debt (6p-15p in the £1 :eek:) & then use underhand tactics to fleece the debtor. What happened to the Bank/Card Companies responsibility under the Banking Code to -
Quote - "We will deal quickly and sympathetically with things that go wrong and consider all cases of financial difficulty sympathetically and positively."
Yeah right....lets offload asap ( often within a month) to collectors who use bullyboy tactics to con the debtor into repaying what they do not have. Lets face it....if we had the money we would not be in this mess!!!

Hi does anyone know the answer to this? Are we really legally bound to pay DCA's? After all we have no agreement with them - when we took a credit card we signed an agreement between ourselves and the credit card company - was there something in the small print that said they could sell it on?0

There is something in the Terms and Conditions relating to an outside agency can be engaged to collect ourstanding debt. The person to verify this will be 10past6, who is an astue expert on the legal side of agreements.
Great programme though. Sure debts still stand, most folk do their level best to sort it out, but the DCA firms, just make it worse for people already in trouble.

A creditor can legally sell ("assign") a debt and right to collect under Section 136 of The Law of Property Act 1925.

I know that they can sell on debt but does the debtor have to give confirmation of their personal data to that said 3rd party & can ( under DPA 1998) the original lender share that information if the debtor ticked the box to say `no`.
Maybe a bit pedantic but somewhere this process seems flawed IMO.

this program show how we are treated with contempt and disregard and they are getting away with it !
and also how the OFT and CSA are useless and have no teeth at enforcing their so called guidelines and code of conduit .....
i like the part towards where marlin said we are confident that we are following the OFT guideline and we have strong enforment procedure to make sure that our staff respect the
law or something to that effect....
