FOS upheld claim, but no payment from Egg

Hi,

I took out an EGG loan with PPI in 2003, and originally complained to EGG about the potential PPI miselling 18 months ago. They disagreed and I complained to the Financial Ombudsman service, who upheld my claim and notified EGG of this. It's now 10 weeks since the FOS decision and my acceptance, and no refund from Egg has been forthcoming. The original loan has been repaid early, so they have no excuse not to refund me directly. I call and call, but am fobbed off - the latest excuse being they need to get the formula for refund calculations agreed by FOS. They have no timescales for this and are just unhelpful about when this will be sorted.

Anyone else having a problem getting a refund from Egg with a FOS decision already given?

I have flagged this with FOS, and I understand they are speaking with senior management at Egg, but in the meantime nothing seems to happen on my case.

    I have a complaint with the Ombudsman at the FOS as Egg have not even bothered to reply to them about finding in my favour. I see others posting on here waiting for payment but only if it has gone through the FOS.
    Hope this is sorted soon for you and others, 10 weeks is ridiculous.

    I am having exactly the same problem with similar time frames, other than i have only been waiting 3 weeks since agreeing with the ombudsmans decision. I have also phoned Egg who fobbed me off with the same excuse. I regularly check on here to see if anyone has any new advice but it seems like we are stuck until Egg want to pay, what can we really do? Good luck though

    Yes it is hard to know what to do to fight back. Have written to the CEO of Citigroup who own Egg, but I'm not feeling very optimistic.

    I have been waiting for a resolution in exact same circumstances since the middle of May 09. I contacted the FOS to find out if they indeed were holding up the process as EGG had told me in a previous phone conversation. At that time EGG stated that they had sent figures to the FOS for approval. The FOS stated that this sounded like porky pies as they had never received figures for approval from EGG in any single case previously and it would be highly unusual! It seems EGG are snowed under by successful claims against them and will not admit it. I called EGG today and explained I had been in contact with the FOS and that I would not accept this possible "lie"! They are now promising payment asap and will be working on my successful ombudsman ruling on Monday! I have been given a contact name of the person dealing with my account and they have stated they will pay the funds to my bank via BACS transfer. We will see! I WILL KEEP YOU POSTED :mad:

    Hope this goes through quickly. Had to wait about 2 months for my Barclaycard Loan claim that had been upheld from FOS. In the end they just paid it in to the bank account of the person I was claiming for. No Notification and no figures. Wonderful. Hope this gets sorted quickly for all concerned.

    EGG are absolutely disgusting ! They have no morals.
    What annoys me is that if anyone ever has a late payment or is in arrears with EGG they are bombarded with calls, emails and letters but when it's the other way round it's the complete opposite.
    SHOCKING !! Don't give up though everyone , keep fighting.:mad:
  • I am having the same problem with EGG I am contacting them every couple of days, today I got told the same old story that its in the system to be calculated. They have been telling me this for 6 weeks now.

    I am getting really cheesed off with it. I work in the financial services and we have to work to guidelines set out by the FSA, this is not fair I think the FSA need to be informed about this.

    I have just phoned Egg but could not get through to the customer relations department. Instead i was trasfered to the credit card department and had quite a helpful girl who after attempting to transfer me several times without success, put me on hold and walked over and asked them what the situation was.

    She said they informed her PPI payments were being processed this week (but no specifics on my claim) and somebody would definitely call me tomorrow morning. I wont hold my breath but thought i would update everyone anyway.

    Egg are THE most frustrating, annoying bunch out! After considering my claim for missold ppi on my loan for approx 3 months they decided last week to uphold my claim - hooray? No! Without any consultation or discussion they refunded the entire amount of ppi payments, interest etc (total of just over £4800) to my loan account!! My account is still active but is not and never has been in arrears, no payments have ever been missed and I specifically told them on several occasions that any rebate should be made to me personally. They are now telling me it is a 'business decision' and Egg's policy to transfer any refund against any still active loan. I have been through the set off rule with them and the fact that the ppi agreement is entirely seperate with seperate signature required but they just repeat parrot fashion that is is a business decision etc etc. Also tried to tell me it was in their T & Cs - I'd like to see that eg "If it transpires you were missold ppi we reserve the right to keep the money anyway etc etc" Have sent a solicitor's letter giving them 7 days to sort it out and send cheque and have also spoken to FOS who are going to right to them requesting they reconsider but I dare say even if I end up succeeding in this it will probably take them another 6 months or so!! Talk about a hollow victory! Anyone else had this experience?:mad:
