Well people I am back in business (primarily thanks to Tixy and her technological wizardry! Found that my system reset which saved the laptop also wiped my printer drivers so had to download those too, hence the delay!
Here goes nothing - first of all the reply to Santander complaints dept, then to the collections and recoveries dept they directed me to. For those who aren't up to date, I wrote a letter to Santander requesting closure of our current account enclosing a cheque for the total amount overdrawn. There were pending charges of £10 - I have copied below the letter I sent closing the account and the terms of our settlement. They cashed the cheque then added the £10 charge, and £465 in further charges later they are still piling them on............
Firstly the letter I sent to them (I've probably uploaded this to the thread before)
Sent November 2010
Please find enclosed a cheque for the amount of £130.40. This is the amount my account is overdrawn, and further to my recent complaint I had requested that the account be closed.
The fact that the account has not been put on hold during the complaint process, means that you have continued to accrue charges to the account totalling £125.00. I dispute these charges as I feel that I made clear my request for the account to be closed. I am happy to repay the overdrawn amount, however I refuse to pay for the unnecessary charges accrued.
Should you accept the cheque for £130.40, it is strictly on the basis that you agree to close the account instantly, and that the account has been satisfied in full and will not pursue me for any further amounts. If you are unwilling to proceed on this basis then please return the cheque to me, and I will pursue a complaint with the Financial Ombudsman Service regarding the matter.LBM 30/6/9 Unsecured debts [STRIKE]£25,323.48[/STRIKE] £0 :T Debt free

Now here is the letter I sent July 2011 as I noted they had continued to pile on charges and were now pursuing me for £365 (its now £465 today)....
Despite my letter dated 20th November 2010, I note that you have breached the terms under which my offer was made. You have continued to accrue charges to this account, and are therefore adding to my existing debts despite being aware we have been experiencing financial hardship. The amount you state I owe is compiled entirely of charges, £125 of which were outstanding at the time we made the offer. The actual amount owed on the account at this time was paid, due to a lump sum received by my wife as she had overpaid her student loan – otherwise we would have had no means of paying that either.
I write to request your final response on the matter, in order that I may refer my complaint to the Financial Ombudsman. I await your urgent response, and have copied this letter to the Debt Collector you have referred my account to for their information.
Bank are supposed to treat their customers fairly, you have not acted fairly on this occasion.
Yours unsincerely,

Next they sent me a reply from the complaints department, stating that they were unable to deal with my complaint......
I sent to them....
Thank you for your response of 14th July 2011, received today.
I am disappointed that as the Complaints department you feel unable to deal with my issue of unsatisfactory service. I believe this to be misleading given that my issue was indeed a complaint, regarding your inability to treat customers fairly.
I note further that you have only provided a telephone number for the Collections & Recoveries department. As my complaint was made to you in writing, it would reasonable to assume that I intend to continue corresponding in writing, and have no intention of dealing with the matter by telephone. I note that you further provide a telephone number for the Central Complaints Department which amuses me. More than one complaints department? I have made my own investigations and have now been supplied with an address to refer the matter in writing to your Collections and Recoveries department.
I am furthermore amused by your inference that I “may” have the final option of referring my complaint to the Ombudsman. Had you read in any detail my correspondence of 7th July 2011, you would note that this is my intention and indeed my right. There is no “may” about it.
I will be passing your vague response to the Ombudsman as part of my case.LBM 30/6/9 Unsecured debts [STRIKE]£25,323.48[/STRIKE] £0 :T Debt free

And finally, the covering letter sent to the Collections & Recoveries dept with a copy of the last posted letter ...........
Please find enclosed a copy of a letter addressed to your complaints department on 7th July 2011. I have since received a response from them asking me to address the matter to yourselves. As I have no intention of retyping my complaint, as I believe it was reasonable to address my letter to the “COMPLAINTS” department, I have enclosed a copy for your information.
I await your urgent “final” written response, in order that I may present this as part of my case when referring the matter to the Financial Ombudsman Service for investigation.
I note with interest that despite an initial complaint being lodged on 7th July 2011, you have continued to apply charges to the account.
I do hope these are up to my usual standard of witty letter writing............LBM 30/6/9 Unsecured debts [STRIKE]£25,323.48[/STRIKE] £0 :T Debt free
