Delurking - relatively new to this.Whats a CCA? I have S*nt*nder chasing me for fees charged to an overdraft which was created by them paying a DD I asked them not to. I have repaid the overdraft but not the fees .............. its a long story............but I am wondering now if I can say this is my F&F etc. etc. Is there a template letter somewhere on MSE?
I just won my fees back from Santander in a similar situation - read a couple of pages back.

Had a rethink re: my strategy during my very long loungy day in bed after nightshift. Have decided against making a F&F to Barclaycard. After all they don't have the CCA, and I'd like to get rid of the overdrafts etc. that are hanging over us.
There are 2 old HBOS overdrafts one was £500 which has risen to £699 with charges. I will make a F&F on this - haven't yet considered how much but it will be based on the actual amount owed not with charges etc.
The other HBOS overdraft was £700 which has risen to £1100ish with charges. Again planning to make the same. Both are being passed around like a hot potato. One is with iQor at the moment, and my plan is to ignore it a bit longer as I see from some posts on here iQor seem to dish out F&F's quite easily. Thought I'd let it be their suggestion.

A move to Oz is one heck of a motivation for kicking the back side of any debts.
It is something we have thought about and would love to do it. But OH broke his knee last year and has only just had surgery to repair the damage. He can hardly walk and certainly can't work atm, so all plans have been put aside for now. We literally plan from one week to the next and no further!

Ok, have now shredded half of the mail I no longer need. Cheque has been posted to Santander to repay last of the loan - soon to be one debt less.:j:j:j
I note I have already been offered reduced settlement on one of the HBOS current accounts which has actually jumped to £1362 inc charges from an overdrawn amount of £700:eek:. They have offered a reduction to around £1100 (how generous:rotfl::rotfl:). Have decided to offer them 50% of the actual amount the account was overdrawn. The letter will be typed as we speak. I will keep you all posted as to my success. There was a default posted in April 2010 - they received nothing from us at all in 2010 and nothing since. OK so one debt at a time then.
The HBOS overdraft totalling £771.50. The actual amount "borrowed" was £500 - the remainder is made up of charges/interest.
It's been passed around, so far gracing the desks of Robinson Way (who sent me a letter stating they will no longer be managing the account - they didn't so much manage it as just send a couple of letters), Wescot and more recently Moorcroft. Lucky me.
Now I don't see anyone in the forum mentioning F&F success with Moorcroft, and I hear mainly that they are a shower of @rses. So my thinking is that I will send my F&F to HBOS direct. If no joy, then I'll leave it a bit longer and see who else has the misfortune of being passed my debt:rotfl::rotfl:.

Letter is done, just the usual F&F template including our own circumstances. But put this little paragraph on the end.
"This offer is made on the clear understanding that, if accepted, neither you nor any associate company will take any other action to enforce or pursue this debt in any way whatsoever and that I will be released from any liability. This sum is not to be considered as an instalment to this account but will only be offered as full and final settlement.
I explicitly require your written response to this letter clearly setting out your agreement (or otherwise) to the above terms. If you choose to write to me asking me to contact you to discuss the offer, I will assume that you are seeking to inflate the amount I can pay which I have already stated I am unable to do so. If I do not receive your response to this offer by 20th September 2011, then I will seek to offer these funds to a different creditor, as I will assume that you have declined my offer of payment.

Just tackling a similar letter to iQor re: the HBOS overdraft deemed to owe £1362.54 despite the actual overdraft being for £700. The charges and interest have inflated the debt by almost 100% - a fact highlighted in my letter of course. WOW! Just researching and starting my Visa application process for Oz. Initial application fee is £1992.30 in "our" money:eek::eek::eek:! Needs to be paid at the time of application - followed by a second installment of £2669.14 when the VISA is complete. Better start saving!!:money:
