Sorry to hear that kirsten, it's a horrible feeling.

If you are sure that you do not owe them this money then don't pay it. If you pay and then try and claim it back it's very doubtful you will see it again. You will accept the liability of the debt if you pay it.

Unless you asked and paid for the kit to go special delivery, it won't have. But you say you have proof of posting? Is it possible to dig that out?

If you have I would send a letter to both Ann Summers and the collection agent enclosing a copy of the proof of posting and state that this debt is false.

I don't know the ins and outs of collection agencies but I am pretty sure that they can't just show up at your house without prior contact, some notification that they have taken over the account.

    Have a look at this:

    http://www.oft.gov.uk/shared_oft/business_leaflets/consumer_credit/oft664.pdf
They have no rights to entering your house and seizing goods. If anyone does come round, don't let them in.
Hope that is of some help :) I'm currently researching into this for myself so I'll let you know what else I uncover!

    Thanks rainy!

I am in a bit of a tizz over it lol

I remember looking out my kit invoice and the proof of posting about 2 months ago, but I have no idea where it has gone since then. I wil try to dig around for it and then draft a letter.

The card through the door has a number on it so I will call and get an address to send my letter.

My partner sent it and our contracted taxi driver took him to the post office with the parcel, and brought him home without it!

If i cant find my receipt, i really dont think I have a leg to stand on so I might just have to grit my teeth and pay up, should have got special delivery. feel like such a plonker.

It's always the times when you think it'll be alright and then afterwards realise the desperate need of special delivery. I have done it sooo many times :o Oh the benefits of hindsight!

Hopefully your reciept is in a safe place and hopefully not in a safe place like mine where I can never remember where said safe place is!

I've had issues sending stock back and the other end just not crediting the right account. There is the possibility that AS has done the same.

Be careful when calling the agency, they might try and engage you into talking about the debt and I know that they can be quite forceful.

If it gets down the line and you can't find your receipt or they are just not having any of it, usually when a third party agency is involved they have 'bought' the debt at a cheaper price from the company and then try and get the full amount back for themselves. It might be possible to negotiate a percentage of the amount to pay back rather than the whole thing.

On a plus note, I am looking into doing usborne books from home, may get me an extra bit of cash to help us out a bit, but I cant get my mind off this thing

It is very upsetting and Im looking for a pick me up. Have my friends over for a sleepover tomorrow night, that may take my mind off it. I hope!!

Thanks again Rainy, you have made it a bit clearer for me!

I have put things into perspective a little bit and decided that I worry too much

I have given myself a mental shake and after learning that none of my safe places are in possession of my receipt, I am just going to have to pay it, the last thing I want is a CCJ, and I think that for my own peace of mind, I dont want this hanging over me.

Therefore I am setting myself a todo list every day, with the intention of being more organised and bringing in/saving the most money ever known in the history of MSE :rotfl:

Here is my goal for tomorrow...
    - add 10 items to ebay
    - tidy the house for my sleepover
    - work 1 hour overtime (every little helps lol)
    - do all surveys available in inbox
    - check for mystery shops in area
    - pre cook food for sleepover and make sure all friends know to bring wine!! (thats nothing moneysaving lol they always leave some for meeee!)

tonight I will list 5 items, and make tomorrows sandwiches

anyway, I will do a list every day, and let you know how I do with each thing. :D

Grrr! So unjust as it really shouldn't be your debt. I would still try and see what you can do but I am a hardened case now with these things. I know and understand the feeling of having these things hanging over you and it is draining to say the least.

But plough on with your lists...putting them on here means you can't escape them! And have good old fashioned letting hair down fun tomorrow night.

Always enjoy the wine that little bit more when I haven't paid for it! :D

    Hi Kirstenc

    What a lovely upbeat diary.

Sorry to hear about your Ann Summers debt. I know the feeling of "unjustness" after recently having to fork out thousands of pounds on solicitors fees to defend something that I didn't owe. I have had to try and accept it and not get bitter and twisted but very hard.

Mystery shopping sounds good - how do you go about joining ?

Turfy6 - was wondering if you could recommend a bread maker ?

I am looking at all your tips and trying to incorporate some myself. I also have problems with oh - I could scream sometimes. He doesn't have the stress of dealing with all the finance and so it seems he doesn't mind burying his head !!

Thanks very much to all of you for the positive comments, they are very much appreciated and they are helping me alot to stay focussed on the bigger picture!

Mystery shopping wise, I am with gapbuster (places to eat usually) and retail eyes. they are relitavely easy to join, and I just log in when I can to have a look if there are any assignments in my area. the most recent one I did really paid for the meal, but that was our date night and we technically didnt spend a thing!!

Thanks again people for reading my diary and keeping me company! :p
