You're not missing something Carefullycautious.
There are some unbelievably pig headed people out there. They think that if they dig their heels in that Welshwoofs will eventually accept their offer leaving them free to sell their property for 40k-50k more.
I'm sure their solicitor has advised them that what they are doing is a dangerous gamble which could cost them dearly but they obviously think that all they have to do is show up at court and talk about their children and the judge will be sympathetic.
I'm sure that their solicitor has told them this plan is very unlikely to work but as a solicitor myself I know how often clients refuse to accept what they don't want to hear and instruct us to do the direct opposite of what we have advised them to do. As another solicitor posted earlier up the thread, we are paid to do what our clients tell us to do not the other way around. As long as we have plenty of evidence on the file that we strongly advised against whatever bonkers course of action they have asked us to take we won't get sued and should get paid regardless.
I would get moving with the litigation personally. It will hopefully scare them into improving their offer at an early stage. I'd be very surprised if they had the money to take it all the way to trial as they will have to pay their solicitors on a regular basis, eg monthly or quarterly. Right now they have probably paid a retainer of about £500 and are expecting that all this will go away before that money's spent. The money they'll be asked to provide once court proceedings start will probably scare the poo out of them.0 -
i wonder if they could be using this time to find another property for themselves to buy if the mortgage they were offered will not buy them the original off-plan property they wanted - are they just buying some time here ?0

I doubt it. They wanted their dream new-build and are now throwing all their toys out of the pram cos they can't get it. Compromise isn't in their vocabulary.0

I think that often a solicitor’s client thinks that they are still ‘in with a chance’ as the solicitor is still seeing them when they ask, and advising them. There’s only ever one reason they’re entertaining them. It’s a business for profit.
To sit there, pay, and not take their advice, is just downright stupid. Either that or they think the solicitor is wrong or uncertain. There are of course legal cases where the solicitor is ‘on the fence’ and a tad undecided, and they’ll usually tell you that too.
This definitely ain’t one of those cases!0 -
i vote that we all join forces to create a SAS type taskforce taking them hostage and forcing them to watch the tweenies til they finally see sense and hand over the keys to the house.

O/T - I was once trapped in hospital for two months on a ward where it seemed everyone else was a Big Brother fan and insisted on watching it. Now that WAS torture, and did nothing for my blood pressure! Even these people don't deserve the BB experience!They deem him their worst enemy who tells them the truth. -- Plato0 -
