gutted - he might get away with it

think this is just a rant but if anyone has advice it would be gratefully recieved.
Ex and I split 10 1/2 years ago, CSA involved from Aug 1999, eventually got 1st payment via DEO Sept 2000 at which point he packed up his job and went to live in Sweden where his mate offered him a job so he could avoid paying for the kids.
fast forward May 2009 and out of the blue I get a letter from the CSA saying I would be recieving £470 per month - £230 of which is towards the £24000 arrears!!!! The arrears kept building up whilst he was away as he didn't tell them he was going - I didn't even know he was back in the country.
I recieved the first of these payments last month.
Now to the moan.
He is appealing the arrears and I spoke to the CSA today and was told the arrears that built up whilst he was in sweden (Jan 2001 til Dec 2008) will probably be written off because he was out of the country - all he has to do is prove he was resident in sweden.
Can't believe he is going to get away with not paying for his 2 kids for 9 years - they are 15 and 18 now and whilst part of me thinks can't miss what I never had, but its the principle.
Don't spose anyone knows how long his tribunal/appeal/whatever it is will take? Looking forward to the gloating phone call afterwards:rolleyes:

He is required to prove he was none habitual resident but first he needs to prove he requested a change of circumstances in that he moved abroard. the fact he is back in the uk means he never really gave up his residence from my experience of First Tier Judges I dont think he has any where to go, I suspect your arreras will be safe but if you have any more problems PM me and I will refer you to a pro bona unit to help you with your appeal0 -

Hi LIbby, I have similar situation and I hope the BEST for you! I could kick myself, as I TOLD CSA my ex had moved, hence they say that my honesty has cost me a situation where the ex isn't within their jurisdiction and they have closed the case.
I'm hopeful for you that this won't be the case as nobody actually ever told the CSA.
I think it is disgusting that NRP can up sticks and move countries and potentially get away with this, what do others think?

He has to have told the CSA he was going - it is too late for him to tell them now as their legislation requires for them to continue charging as though nothing had changed unless the changes had been reported to them AT THE TIME.0

thanks all, I might have hope it seems. Does anyone know how long these appeal things take - I have no contact with my ex, I only know about his appeal as he told DS that he has a solicitor who will get him off the hook so he can give DS money instead of me!! ( he hardly did before so why my son believes him now!?!)0

I love the way it always turns into 'I'm not giving him/her any of MY money' as if you never spend the money on the children. :rolleyes:

CSA really need an overhaul. I am currently in a no win situation, ex not habitually resident in the UK since Feb 09, yet he can return to the UK every 8 weeks for 2 weeks to his rented house in the UK which he shares with his fiancee and her 3 kids. Because his name is not on the rent book, he has no UK bank account and the fiancee claims every benefit under the sun. Government say, that's fine as long as he has signed our paperwork and there are no financial associations. Sometimes it's just not fair! However, I believe what goes round comes round and boy do I want front row seats LOL...0
