tkmaxx mistake!!!

hi, I bought a pair of sunglasses 29th june 2009, they were too small so I took them back to get refund, ive got my receipt and the original tag is attatched, the lady behind the counter said she couldnt refund me cos the tag had the code for toys on it, and therefore the receipt said £5.99 toys, i hadnt noticed this, but it is the receipt they gave me when I purchased the glasses, and for the correct amount so it is the correct receipt for them, ive NEVER bought any toys from there!!! they will not accept this, and have basically accused me of swapping the tags over to steal a measly £5.99 what canI do??? theyve put the wrong tag on them not me!!! ive got to go and see the manager tomorrow, im so upset !!!

    Maybe so, but dosent TK Maxx have an exchange policy displayed at the tills, they cant change it on a whim surely ?

    of course they can

    its completely discretionary

    Im not so sure, when you buy you are buying knowing the terms displayed at the till and the back of the receipt, if they change it then it cant affect customers who have already bought under those terms.

    its not displayed as terms of the contract though

    its a policy

    policys can be changed as and when they wish

    there was a post a few weeks ago about m &s changing their policy and the view was there is nothing you can do

    Ask them to scan the tag again and see if it still comes up as toys.

    Does the receipt have the 14 days change of mind terms on the back? If so I would maintain that it is valid for the goods it pertains to.

    Anyway the OP's problem isn't the refund policy, it's the fact that the item on the receipt is not described as it should be. Surely this can be sorted out if they just run the bar code through the reader again.

    You have to show 'Proof of Purchase', yes a 'Receipt' for the items is preferable, but all the shop needs to do is audit the till that the items were sold from, it's not the OP's fault if the shop person was too lazy to remove the previous persons receipt from the till. Then some other person (could have been the same one) gives the incorrect receipt.

    The OP will I assume remember the approximate time of the purchase? If so, get the manager to look at the till roll and find out if there were any purchases at that time for the amount you paid. If they refuse, leave and you can take further action later such as a data information request etc.
