Any refund/replacement is entirely discretionary.
perhaps I should explain further... they put a tag on the glasses that had the code for toys on it, so therefore my receipt came up with toys £5.99 not sunglasses £5.99, so they made the mistake, and are blaming me for it!!!0 -
I have every right to exchange goods if they are not suitable
No, you don't.
Try just asking nicely - reasonably, pleasantly but firmly, if you can. As the advice you've already been given above says, it's not a statutory right you're asking for, so it'll be down to store policy and the manager's discretion, I'd say. Customer service staff (in this case the store manager) tend to be more helpful to people who are reasonable and pleasant, than those who are aggressive. Fair enough, if the law's on your side, charge in as loud as you want (still counter-productive as a first step, IMO), but in this case it isn't.
Oh, and don't use the word 'incompetence' in your opening remarks!Reason for edit? Can spell, can't type!0 -

Actually you don't have every right if they are not suitable. As others have said, a replacement/refund is their policy, and they can change it as and when they like.
The only way you would be entitled by law to a replacement/refund is if the product was faulty/not fit for purpose - and by that they mean bad quality etc. Not the wrong size. It is your responsibility to ensure the size it correct.
However saying all that, I would just ask them to exchange them or give you a credit note, some places will do that without a receipt, so go back, without the receipt and just make out it's a new enquiry. Think happy & you'll be happy
I :heart2: my doggies

Well you were, a bit - but that's why the forums are good - you can come in here, let off steam and then go and do what you need to to try to get it sorted! All the best - but it's only going to be a 50/50 chance, I reckon. If they don't, then put it down to experience and move on. Hey, they'll come in useful for a fancy dress, sometime;)Reason for edit? just a shot in the dark ... is it possible the sunglasses are small because they're a child's size? & that's why the toy tag's on them?0

Good luck Lesley.
I understand what you are saying, but I think the person you saw today didn't 'get it' and thought you had changed the tags. Stay calm and common sense should hopefully prevail, if it's not solved instore by the Manager then by all means contact their HO.
It may be worth having a look on the shelf where you got those sunglasses, before you see the Manager. Memorise part of the barcode and check and see if any others being sold tomorrow have the same 'toys' tag? Be careful not to get your pair which you want to return, out of your bag at all at this point, or security may see and think you've gone and put a pair in your bag!
I would think it's quite possible a whole batch of them have these tags (maybe they ARE toy/kids sunglasses which is why they are coming up small, but tkmaxx haven't realised that?).
HTH, if the whole batch have the wrong tags I think they owe you an apology!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

That sounds like a probable explanation. Good luck with the refund, let us know how you get on?A minute at the till, a lifetime on the bill.
Nothing tastes as good as being slim feels.
