In employment law the employer does not have to prove that the employee is guilty of the conduct complained of.
What they have to do is to carry out a thorough investigation - including discussing the matter with the employee concerned - and then come to an honest and reasonable belief, supported by the facts available to the employer at the time.
So if the employee has any information at all that might help his case, or any mitigating circumstances that he feels should be taken into account, it is in his best interests to cooperate with the employer.
Refusing to say anything, or to cooperate with the investigation on the basis that the employer cannot PROVE it was him, will not help his case at all.I'm a retired employment solicitor. Hopefully some of my comments might be useful, but they are only my opinion and not intended as legal advice.0 -

I have no intention of being unhelpful or trying to be smart by giving 'prove it' type responses

Oh well.....fair 'nuff then O.P. - ie that you intend to be truthful. I wasnt advocating an aggressive "prove it then" type response - more a puzzled, "dont know why you think that Forum poster is me....it obviously isnt" response. It does feel a bit "sick-making" to think of having to take a response like that - but it feels VERY "sick-making" if one has ever seen just how much spying on their staff some employers do get up to...CocoPopsLover has obviously seen some of this in action as well....:cool:

I do find it strangely amusing how they found out I was on the site 2 days after joining though, and I absolutely agree with you about employers!!!
I just feel (after speaking to my girlfriend) that I shouldnt have made the employment comments in relation to my employment (which a lot of you have said as well) and all I can do is face the music and explain why I thought that I had not breeched procedures in making these comments.
I just feel like GM is OTT but they obviously feel my comments were that serious. I just dont see how they can trust me after accusing me of GM which is why I feel like they will more than certainly dismiss me, as someone earlier said, working in a bank is about trust and once that trust is broken, there is no going back.
After my hearing, it will be me posting a thread written 'is there life after being dismissed from a bank', lol0 -
I'd go on the offensive myself. Ask who has accused you, who has given them information ? They won't tell you of course but it makes them look bad with unknown informers snitching on previously good employees. Then say well if you won't tell me where this came from, it must be suspect and slanted, and this is unfair and might be victimisation - I'm going to ACAS. I was being a good representative of this bank, I was helping a customer, & look where it got me !
Never let bosses get you down, NEVER. They are bosses because they're the crawliest and most devious people in the building !0 -

The bank probably just aasked the forum who the poster was.
If the registration had any personal info they might have just given this out.
If the regsitration was not truly anon(needs no personal info and multiple users of the IP address) then it could be unwise to deny being that user.0
