    They are a power seller, not a power trainer. They may well have read your communication but they are only covered if they send to your paypal address. It isn't up to them to type a long explanation of the rules of ebay and buyer protection and how it works.

    Please just send the item to your dad, close the dispute and read the ebay guides before you buy anything else.

    I can't believe you received the item at your paypal address and opened an 'item not received' dispute.

    I also refuse to send to another address as paypal would not cover me.

    There is no dispute to be had. You bought an item, you told them to send it to your home address (and yes you did as this is your paypal address), they sent it.

    They have completed fulfilled their contract.

    To be honest you should have contacted them before buying.

    You are absolutely right. Unfortunately it is this sort of buyer that makes sellers think all buyers are scam artists and out to get them. This thread rather supports that view..sellers beware..dodgy buyers around.

    I know if I had sold something & then the buyer kept e-mailing to send to a different address, alarm bells would start ringing that this was a scam.
    Yes the seller should have e-mailed you sooner to advise why they couldn't send to an alternative address, but that is the only mistake they made. As others have said you can show this as poor communication in the DSR's. To leave a negative would be unnecessary & very harsh.
    Just like you used Paypal for your own protection, sellers also need to protect themselves. The only way they can do this is by sending to the registered address on Paypal.
    I think you should close the dispute ASAP (hopefully you have already done so). Ultimately you have received the item & (I presume) are happy with the item. What you decide to do with it now is up to you. There are some good links on here to cheap parcel delivery services that you could use.

    Considering how you have an ebay email trail stating you received item at the paypal addres... you aint got a cat in chance hell of winning a dispute.

    But seriously... i've had a few scammers try and rip me of a few times with ebay and sending to paypal address is only way to limit your losses somewhat.

    Can someone advise me please?

    Would the actions taken by the OP be classified as Fraud or trying to obtain goods money or services by pecuniar deception? Obviously she has receieved the goods (as indicated both on here and probably by a receipt in the couriers possession), yet claiming goods not received.

    I know if I were the seller I would be looking at reporting this action to the police, but it has been a long time since I did my law courses in consumer law and I just cannot remember which act this would fall under.

    Rebel, you raise an interesting point actually. I am not sure i would like to say 100% whether this is fraud, but from a lay persons point of view claiming something has not arrived when you have it in your possession does seem rather clear cut.

    I think with sellers getting more militant against buyers I would not like to have to explain my way out of this one if seller reports it to the police. I am rather ashamed to say that I have reported a buyer to the US state police for working this same scam on me (claimed non receipt after saying item had arrived but he was cross at his adult child having used his paypal account to buy it) and they did take it seriously. I had one awfully cross buyer, you cannot begin to understand how upset he was , but he dropped the claim and repaid me instantly.
