They cannot take money from your bank account unless you are daft enough to give them the name of the account, the account number and sorting code. Never, ever give out these details to sub-prime lenders or so called 'brokers'.
I used to think that good grammar is important, but now I know that good wine is importanter.

I too (in a moment of desperation) agreed to pay beneficial claims the sum of £245, to clear a debt of £8k. After a bit of investigating, I called them back and said I didn't wish to proceed. The woman on the phone would not take no for an answer. I hung up, then called back again in the hope of speaking to someone else. It took until the next day to finally get past all the recorded message junk, just to be told that it was too late to stop the money being taken from my account. I took all the cash out of my bank hoping that the request would bounce. But no! They still managed to take it. I am now still trying to get a refund of MY money. I was told that they have a strict 30 day refund policy. 35 days later......Nothing. Plus all the charges for going overdrawn too. I'm sick of these thieves and con artists praying on people that just cannot afford this kind of thing.

Oops, I forgot to add the fact that they told me on numerous occaisions, that they couldn't actually help me anyway. So they admitted they couldn't help, but then still STOLE my money. This may sound harsh, but that is exactly what they've done, Stolen my money. Ever so slightly furious!!

Please explain how this is ANY different from you trying to STEAL £8,000 from someone who lent you money??

I mean, apart from the fact they only stole £245 from you, nowhere near the £8,000 you are trying to steal.
• Anyone who gives out their personal details (and bank details) over the phone or the Internet must accept the consequences. However, if you feel that the company has somehow got your data by unfair means or you don't know how they got it, ask them to tell you - under the Data Protection Act 1998, section 7, you have the right to make a 'subject access request' in writing (they may charge £10 max fee but some don't) and they have to tell you what data about you they have and where they got it.
If they don't, you can complain to the Information Commissioner's Office (ICO), which is responsible for enforcing the Act.

Hello, everyone.

I have recently (in a moment of panic and stupidity) contacted Yes Loans to see what they could offer me for debt consolodation. I did pay them the fee and thus far no loan has been found for the amount requested. My first question is - what do you think the chances of getting the fee back is, and is there anything I could put in the letter to push them into refunding?

The second question and the part that has bothered me most is I was put on to someone from 'Beneficial Claims', who gave me a bit of a hard sell on the CCA un-enforceable debt malarkey for my credit cards. I told them they could send me the bumf out for me to read, but I wanted to look in to it before agreeing to it and paying the £100 fee, so they did send the bumf out, I read the rubbish in it, then had a look on this website (wish I had looked up Yes Loans here too!!!), and to be honest I think i'm in the - I spent the money, I'l pay it back school of thought. So I phoned the rep I was given at Beneficial Claims and told her I would not be wanting to proceed, she said that was fine, after more hard sells and a few lies.

Then a few days later my debit card was charged the £100 . I would like to know how (if?) I can get this back? Has anyone else had the same? Should this be reported to someone? or will it be a case of her saying she had never received such a call?

I hope someone can give me some advice, and before anyone starts - I do understand it was a stupid thing to do to give these company's my details - lessons learn't.

Incidentally I am glad I didn't get a consolidation loan - I do know its not the best way forward in most circumstances.

Hi there,

I had the same sort of problem, i applied for a loan with this company and then decided not to go ahead with it after i had paid an admin fee of £69.50!! I applied back in april and i have had nothing but troubles trying to get back my money. I had tried calling them, which i stopped as they charge for the call and you are on hold for nearly an hour!!!! faxed them & sent letters.
I received my cheque in the post yesterday for £64.50, (-£5 brokerage fee, as by law they are allowed to take that). If you need tips on how to get your money back email me: hollystevens18@hotmail.co.uk
You can also call the consumer direct on:- 08454 04 05 06
The more people who complain about this company to consumer direct, they will be investigated!!

Thanks Apples, but I didn't actually mean clear as in, Not pay it back at all. I meant to consolidate loads of things into 1 loan.

''Due to the outcome of the call our standard Terms and Conditions apply
of 30days for a refund. Unfortunately we do have a slight delay at the
moment and that is why it appears you haven't had the refund as of yet.''

That was my response yesterday from Beneficial Claims so Ive now lodge a complaint with the claims regulator

Hmmm. I got the same reply when I asked them where my refund is. It's been 40 days now, and they say my claim has just been passed to a review agent. Thieving Bar Stewards, the lot of them. Thanks for the info ISSYTM.
• In a moment of desparation in January I contacted Yes Loans and was unknowingly transferred to Beneficial Claims. After some hard sell in which they told me I had a 95% chance of having my debt cleared, I agreed to them attempting to get one credit card written off with a balance of around £6000. I paid a fee of £480 which included a £220 admin fee, and was told if they did not succeed in clearing the debt, I would get £260 back, but would forfeit the £220. This was a gamble, but they convinced me that they very rarely lost a case, so in effect I had nothing to lose.
Later that month I contacted them as I had received some paper work from them that contained some incorrect details. This time I spoke to an advisor from the legal team "Brannig Parry" who told me I had been incorrectly charged, and I needed to pay another £1400 to them, that again would be refunded if they were not successful. He then encouraged me to put the amount on the credit card they were pursuing, so in effect it would not cost me anything. He also said that I would have an answer from them within weeks, so to pay only the minimum payment to them in the meantime, which would probably only be for one or two payments.
I don't know why I didn't just tell him to ".... off", but I didn't, and stupidly went along with what he was saying, paid the extra £1400, convinced by him that I couldn't lose, and that BC had an excellent track record with my creditors. He also said he would personally keep me informed of any progress.
The following month I was checking my credit card statement and to my horror discovered that BC had taken another £1400 from me without my consent. I felt like crying, knowing it was my own fault for being stupid enought to get taken in by this company and their advisors. I immediately contacted them and was promised that a mistake had occurred and that I would receive a refund immediately. Several phone calls and two months later I did receive a refund of the £1400.
However, since then my advisor from the legal team has given me inconsistent information when I phone him monthly for an update, and has also denied having told me certain things that BC are supposedly doing for me, even though I write down the details of every conversation with this company.
I am now in a position that 6 months have passed, I have increased the original debt by £1880, thanks to them telling me to put it on the said card, which they assured me would be declared unenforcable by now. I am also only paying the minimum payment every month, around £300, so half of what I am paying is actually going straight back on as interest.
This week I have attempted to contact this advisor in the legal team, who is not returning my calls, 6 to date. I have contacted the customer care team, who say I must speak directly to him, which is difficult when he won't return my calls. I did eventually get to speak to a supervisor, who was not very helpful, telling me again I must speak to my advisor and that he would ask him to call me. Two days later and still waiting for that call.
I cannot believe I have been so stupid and believe that something must be done about this company. Before I contacted Yes Loans I had never heard of BC, but that is no excuse for handing over money and getting taken in by their promises.
So, what do I do now? I do not think I will hear from them again, and will probably never have my debt cleared or get my money back. The FSA appear to know about them but do not seem to be doing anything to stop them ripping others off. I intend to contact Watchdog about them and will also speak to CAB, but I doubt I will get very far.
I think all the people who have been conned by them should get together and start their own group and proceeding against them. Is anyone interested? As for my advisor Brennig Parry, I don't know how he sleeps at night.
