    sorry, but as long as she pays her rent and complies with the terms of her tenancy aggreement its got nothing what so ever to do with anybody else whether or not she lives in her home.after all just because you are a council tennent it dosen't mean that you cannot leave the property for any length of time , eg for an extended holiday,to visit relatives longterm or even if the fancy takes her, to go back packing round the world etc,just the same as any other householder ! !
    if of course she is claiming houseing benifit then this is a completely different matter. but surpriseing it may seem, people who live in council houses do have jobs and careers etc

    I believe that there is a loop hole with local authority housing that allows for you not to live there for long periods of time. As there has been a big up roar in my local area as there seems to be lots of people using the loop hole.

    I believe you have to claim that you are caring for someone else in there own home but you have to go back to your property once a week that is all.

    As far as I am concerned NO property either local authority or private should be allowed to stand empty. There are to many people needing a home.

    I hope that they are sorting the relationship out. And get it on a footing where she can give up through choice her local authority housing so that it can be freed up for another needed family.

    Agreed that are sometimes when a property may stand empty because of death, extended holiday etc. But you can't tell me that is the reason for every empty property.

    How do you know she's not just trying to get the place decorated or something? Or waiting til she can afford carpets etc?

    My agreement with the council states that the tenancy will cease once the house ceases to be your main home. I would guess most agreements would be similar.
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.

    If that is the case then it will be apparent to whoever investigates and nothing will come of it.
    No I don't believe it is anyone's business. Quite frankly, I would safely say 99% of people are being fraudulent, either it be benefit fraud of some description (including tax credits), or people are commiting fraud where tax paying is concerned, ie not declaring second incomes ect..

    You could safely say it, but you would be wrong.

    If the OP's friend is wrong then I would expect that to be discovered by the person that investigates if it is reported.

    No I don't believe it is anyone's business. Quite frankly, I would safely say 99% of people are being fraudulent, either it be benefit fraud of some description (including tax credits), or people are commiting fraud where tax paying is concerned, ie not declaring second incomes ect..

    Tax evading is just as criminal as someone holding onto a council house when they ain't living there.

    I've known people to be wrongly accused of fraud because of interference from outsiders.


    I am on the fence regarding the lady referred to in the OP on the basis that its probably early day to say whether she is doing anything wrong. However, in response to your statement tha "99% of people are being fraudulent" I think you are wildly inaccurate in your estimations. But even if you were right it begs the question - does this make it right? If "interference from outsiders" means even one person is stopped from abusing taxpayer's money then bring it on!

    I hope my statement is inaccurate, but I'm very much doubting it. I bet some people wouldn't even realize they were commiting fraud to be honest, which maybe the case in the instance we have been discussing.

    As for abusing taxpayers money, I think people need to look no futher than the british goverment. Whos stopping them from abusing taxpayers money?? Maybe a telephone line should be set up against Tony Blair and posse.
