Nah, Clutton, there are 3 sets - both parties' view of matters and then " the truth" ;)

I have no doubt that I'll get a flaming for this, but there we go. Those of you who regularly read this board will know my views on LLs who fail to meet their legal responsibilities towards their Ts: I have no time for any LL who doesn't take gas safety regs and tenancy deposit regs seriously.

However, as this thread has progressed my personal view is that the OP is someone who has too much time on her hands. It should be a warning to any newbie LL that if they ignore their own legal obligations then they leave themselves open to a scenario such as this.

Broclo - stop playing games. You obviously spend a fair amount of time reading up around tenancy issues, but posting up the contents of your LLs personal emails to you is not the best way to get things moving.

My suggestion is that you should properly focus on moving forward: this LL & her brother may be fools who don't understand the legalities of property letting but you seem to want to spin this out, possibly to give yourself a sense of purpose?

(I am still laughing at the "serious" suggestion made by someone else that you should starting checking up via the Aussie authorities.)

Contact your local Council's Private Sector Housing Team/Tenancy Relations Officer and the HSE re the gas safety certificate, and get that done as a priority. Most Ts would get on and do that rather than repeatedly post on here about their LLs personal tax affairs. This seems less about you actually getting matters resolved and more about filling your time.

You can also raise the issue of the lack of deposit registration with the TRO, and with the courts: never mind pharting about playing games over not pursuing it so that you can't be served with a valid S21 notice. If you don't get that deposit registered by the LL/her brother then you are likely to have real difficulty in recovering it when you* do* go. Your first step is to get on and get written confirmation from all 3 deposit schemes that there has been no registration. Your comments about the LL having "spent" your deposit is irrelevant to the fact that the amount has been received by them and will need to be accounted for when you eventually move out.Only one of the schemes requires the LL to physically hand over the funds (edit: to the scheme administrators) :the other two are insurance based and the LL retains the funds.

Look for the shortest route to sorting the bits that really matter, and then get on with your life but you perhaps need to stop focusing your anger/issues from elsewhere onto all of this: it really won't help you or your child(ren) in the long run. You may wish to try to reach a mutual agreement on an early exit from this tenancy.

thank goodness someone else sees through this attention seeking sad young woman - well said tbs

i have also been referred to other posts of broclos and it seems that she paid £4k for furniture in her previous place - so not the penniless mite we were led to believe .... and that one of her children (whose ages seem to vary) may, or may not, have autism .....

it does seem terribly odd to me that a mother of two young children, one possibly suffering autism, is up half the nights till 2.30 posting on forums ?

should we all just call it a day, stop contributing to this nonsense, and go support someone in genuine need - as is our usual custom ??

The visa entry system is very very very very (and thensome) strict.

They don't mess about. Wrong visa, you get back on a plain. Lie on a visa, you get back on the plain and can't come back.

Australia will know her resident status.

    plain or plane ;)
