NRL Scheme-As a tenant should I be witholding tax to pay to CNR/IR-or am I deluded?!

    Yes...certainly if she did get solicitors involved it would be rather interesting to see them explain why the deposit hs not been paid into a TDS and all of the other issues! I think also the solicitor would have a laugh on the 'restraining order' based on some emails :rolleyes:

    Well...I think that is unfair. It was a throw away hypothetical post. Balanced out my MANY stating that basically I just want the LL to uphold their responsibilities so I can carry on living here in peace! I have told of everything and glossed over nothing. A throw away comment does not change my honesty, it if anything just highlights that I was being 'too honest'. I have no desire to do such a thing. I know many members in real life and probably 50 people have my address...do you REALLY think that if I was at a point where I was going to run off(and let's add never pay them a penny just for good measure!) that I would post it here? One throw away does not make my integrity questionable...it is only the LL's integretity which has been disolved.

Yes...I was told my LL, her brother, neighbours etc...the first time it changed as far as I am personaly aware, was last night very late in her incredible email

    Call it gut instinct if you like - but the initial issues of "should i pay the tax or am i deluded" has been clouded and obfuscated with several other matters - Gas cert, epc, deposit etc - but i actually do now think that OP is deluded - as she has got her priorities absolutely upside down. I have acted on the other issues, the GSC has been prioritised and the correct authorities contacted. As far as the TDS, I have asked the LL to put the deposit into a TDS and I am trying to weigh up whether I am in a better position before or after the tenancy ends, information seems conflicting. I am happily dealing with the other issues, but they were raised as it painted a full picture of the LL's attitude to her responsibilities as a LL.

    I find you stating 'dedulded' rather hurtful and even if you now feel your that one throw away comment comprimises my honesty, it is not a nice comment and whilst I may have been 'confused' or 'stressed' by the situation, that is uncalled for.

    i also find it absolutely astonishing that the property has no Gas Cert I have contacted the authorities and sent a letter...i'm waiting for action, nothing more can be done at this moment in time and yet she is spending her time banging Not banging on, i'm asking questions and for opinions! on about tax and has, apparently, made no efforts to sort this out quickly - this is only a life and death matter after all - not a matter of unpaid tax. She has not responded to any posters who have tried to focus her attention on this important matter. Incorrect...read my posts

    If you want to get a LL to toe the line, you go to the local council private sector staff and get them to write on your behalf (especially since relations here are irreparable) - you dont waste time and energy on someone else's tax bill. My liability without a certificate! Councils have legal clout to force landlords to comply with safety/deposit protection legislation - tax men dont. No and neither do the council acttually have any clout according to them or the CAB or shelter. CAB advised trading standards for EPC, EH for gas and the courts for TDS...all of which are being follwed through

    She has got her priorities really wrong I can do more than one thing at a time! - that is why i have changed my stance, and that is why i do not support her any longer You changed hourly yesterday, yet the situation, my attitude or the landlords did not. I have respectfuly taken your advice and was softening my proposed email etc. Although it was of course not sent!. (That is not to say that i support the LL - i dont - i have just been putting the other perspective here)

    There are always two sides to a story - and lets not forget on this forum we only ever have one side Correct...but you do have all the facts

    If this LL is so incompetent - we can have no idea how long ago she serviced this boiler - - i have personally seen properties where boilers have exploded - NOT a pretty sight i can assure you. It was the LL home, this is the first renntal

    i recommended leaving because she and her family will never have peace of mind in this property - she will always have stress at the back of her mind and sooner or later the relatioinship will, as they say, irrevocably break down - if it has not done so already If the LL addresses the issues I have raised then I will not be stressed!

    I still recommend that she leave now while she has some sanity - her childrens peaceful environment should come foremost

    I don't know whether to be :o or :D at that. You should meet my dad, he's had a thirty year head start on learning a lot of stuff, about a lot of stuff!! I find quite a diverse range of subject matter interesting, I like researching interesting subjects and I find it easy to absorb interesting (often useless) facts. :confused:

    lol..I was giggling as you reminded me of my father, he is only 52, but seems to know a little about everything...but you can not be him as you live in yorkshire lol

    Where did she "emigrate" to? If it's Australia then they're very particular about what visa you go in on.

    Yes Australia, her husband is Australian.

    Why do you bring it up?

    I know nothing of the subject of emigration...well apart from watching a stupid reality programme last year for half an hour in my last week of pregnancy as I was too fat to get off the sofa and reach the remote with any ease lol

    The visa entry system is very very very very (and thensome) strict.

    They don't mess about. Wrong visa, you get back on a plain. Lie on a visa, you get back on the plain and can't come back.

    Australia will know her resident status.

    Hmmm, so your saying that I could technically find out her residential status, covering myself over the tax issue. That is interesting, I would have no idea how though. If they would even give it to me.

    I'm not sure though if this then becomes meddling..if the CNR give me assurance I am techically fine.

    Never spoke to CNR or anyone today though as I had back to back appt's for the family :rolleyes:

    I don't know if they'd tell you. But HMRC would almost certainly be able to look at what she's written on her visa application.
    If you wanted to ask./confirm you could always ring the australian consulate up and ask them for advice. ;-)
