    can't say i'm surprised though.

    What if MS won't fix it for free - as in some cases they refuse to (they only seem to address a couple of known faults)?

    they send it to ms because they have addmitted what a peice of absolute s*** they make and have taken responsibility for the faultyness over potentially every xbox made

    so they have requested any retailers send it to them for repair as the retailers wernt exactly happy to carry out lots of very costly repairs for ms's c**k up

    its what most retailers do as i said you take it to them and they pay the manufacturer to take out the repair

    in this case ms have wavered the charge because its their fault and no retailer in their right mind would sell the console with all these faults needing repair at their cost

    ms wont refuse the repair as long as you have a valid warranty

    and if for some one in a million reason that they do refuse then you just go back to the retailer and tell them to do it

    so stop going on about what ifs and get it repaired

    Of course it's palming off the customer. They are responsible for the console yet they pass the responsibility of resolving a faulty product to someone else. The consumer didn't buy from Microsoft, they bought it from the retailer. This may be the law, but it doesn't make it right.

    And again, what are the sellers rights if Microsoft will not effect a repair free of charge. It surely cannot be right that the consumer has to undertake further expense?

    Microsoft have refused free repairs for numerous people who have problems that don't relate to the E74 error or the RROD. Hence the question as to the consumers rights in that regard.

    This has nothing to do with warranties. I'm asking about consumer law.

    ok well im sorry i assumed that it was you needing a repair i didnt read it properly but i am perfectly able to read thank you

    besides all that my point still stands

    from a legal view they are not palming off

    ms have accepted a fault and to avoid retailers from dropping the console due to them forking out for repairs ms have instead said that they will carry out all of the repairs

    so now when you go to a retailer they take the console and admit their responsibility, the only difference being that instead of the retailer sending it off to ms or a ms approved centre for repair and the retailer paying for it, the retailer now simply has to send it off to ms for free

    it is not the retailers palming people off

    its ms providing a crappy product and feeling the pinch because of it

    as for when ms refuse a repair other than the 4 chips overheating in or out warranty, they can do this as you are right this is not their responsibility, in that case you would go to the retailer as before and they under the sale of goods act may or may not have to carry out a repair at their cost this time (not ms's or the consumers). but this repair will involve the console being sent to a ms approved centre

    so there ive answered you questions, the fact is your picking on an issue that is common and does not only apply to the 360

    most retailers try to fob people off when they challenge them on out of warranty goods

    its just a fact of life

    but at the end of the day, if the consumer is entitled to a refund, they will get one no matter what the fault is etc

    Microsoft are right, unfortunately. If you do a search for 'EU 2 Year' on these forums, you will realise how misleading the newspapers have made it.

    If you got the 3 red lights or the e74 error, you console will be warranted until March 2011 (as long as you can supply Proof of Purchase)

    what model is it?

    i thought all models had an extended 3 year warranty now? or have they fitted heat sinks now?

    anyways the eu thing is absoulutly, 100% irrelevant to the uk and people should just completely erase it from their heads

    as for your xbox, if it is indeed out of warranty (like i said wernt they all extended from 90days to a year and then to three years?) the you can go down the sale of goods act route and say the goods are not of satisfactory quality

    now for this you need to deal with the retailer not ms and write them a letter

    consult consumer direct about it and they will give you advice and template but i really think you will have little to no trouble getting a repair under soga as the 360 has a 33% faliure rate within 2 years or something so the inherent fault is very apparent and very hard to dispute so any retailers will undoubtedly deal with it promptly

    do check up on your warranty period

    EDIT: i missed how you said 2 red lights, so yes you need to go the soga route as you are not covered by the "general hardware fault extended warranty"

    Always had Heat Sinks ;)

    It is standard 1 year warranty that covers everything and extended to 3 years for 3 red lights and e74

    now go back to your beloved PS3 lol! ;):D

    yes i read the post wrong and didnt realise they put 2 red lights so thought the 3 year warranty applied

    i did mention in my edit:P

    and obvs they have heatsinks but they dont do much good when theyre on the other side of the mb do they:P

    and i will thankyou very much:)

    having much enjoyment over the new vidzone app for it
