We bought a new B&Q kitchen Dec 08/Jan 09. We planned to have the dishwasher intergrated funny enough, and the hole is still there, just filled with the old normal white dishwasher.
We would be happy with a dishwasher (intergrated) from the B&Q website that we deemed to be of same standard or better.
That way we could sell our old dishwasher for £50, and be quids in for £39 after all.
Only thing we would need is the refund of the court costs etc, therefore forefilling the original contract that was formed on the sale of the item.

Yep. I suppose Bond Pearce are hoping that some people will be intimidated by their copying and pasting reams of quotes from this thread in their defense documents.
The fact remains that 1) They cannot link user names here to RL individuals and 2) Nothing that has been said here has any bearing on the facts, and they know it. We entered into a contract with B&Q, they broke it. The rest is window dressing.0 -
You would have to ask if they used any comments on here why they are only using the "tongue in cheek" remarks and NOT the one's stating we would take comparable items?? I'm sure they wouldn't be using the one's where we state we are willing to take similar items - I wonder why not.

We entered into a contract with B&Q, they broke it. The rest is window dressing.
And those are the basic facts the case will be based on. It suited B&Q to have those T&C's in place as it must have suited them to form "A legally binding contract". It wouldn't have been just for the benefit of the customer. But now it doesn't suit them, they want out of them - "they want their cake and eat it".
They may well (BP) try and put pressure on us, but I can't believe that any judge would not view these cases on the T&C's.
