    Looking at post #193 (page 10) of the kitchen door thread, B&Q cancelled some of those orders but sent customers vouchers as an act of goodwill.

    As the Plymouth B&Q was also selling a 2800ltr tank reduced to £150 from £1800 and a 900ltr above ground tank reduced from £900 to £50 this surely proves that there was no reason to think this sale price was an error anyway. See post #187 by dad46

    It certainly was, many thanks for this, I also can confirm that they were dumping the Roman Column water butts for only £50 at the Wallsend Silverlink store. These were also promoted at exactly the same time online as the 1100 litre tanks.

    So to sum up, these tanks were available, there were no price errors. The error was as per the cancellation letter, see quote below. We can now show that Bond Pearces allegations are pure speculation and possibly a ploy to instill fear to those who have little legal knowledge. What Bond Pearce do have is the term "at our discretion" and to and try and plead with the wording of the cancellation letter. God how they must wish they were prosecuting instead of defending.

    Letter quote:
    This is due to a system error on our website which caused us to continue taking orders for the product after our stocks had been exhausted. This water butt has now been discontinued and consequently B&Q will not be stocking it in the future.

    The system error could only be controlled by B&Q, any mistakes are at their end and as errors can be costly there should have been measures in place, and one of those measures should have been to update the T&C's to allow for this - which they have now done.
    As they had previous knowledge of the problem, I repeat again and again, B&Q were negligent. I will continue to repeat this as well.

    And also I will repeat, I'm still willing to accept my water tanks, I'm still willing to negotiate with B&Q, or indeed BP for a suitable amount for this breach and would probably accept B&Q vouchers as compensation - I still do shop there and that won't change unless they ban me.

    But most of all, many, many thanks for all the help on this forum from all the "helpers" and I stress "helpers" - a great credit to a great site.

    Thanks ambercat for reminding us.

    That's a good summary Lynsey. Bond Pearce win either way; they still get paid. If B&Q felt they were in a secure position to defend their actions they surely would have used their in house solicitors? The fact they have brought in the big guns speaks volumes.

    Personally I am looking forward to my day in court. In my professional capacity I am more than used to speaking to a room full of people. As Lynsey says "Bring it on!"

    Definitely not - it's a 4 inch pipe - bought from B& Q - laid under bricks and, in the future, aimed at keeping the surface rain water away from our house!

    thought you might like this story, someone "reserved" a room for 18 euros, hotel rang them and said it was a mistake and they couldnt have the room. complained to the comparison website who said they were lucky they hadnt been charged the no show fee :)
