The majority of it seems to be a tirade against the purpose of these forums. Bond Pearce allege that there is some form of alert system set up (if there is please someone point it out to me because I've never seen such a thing) to prompt people when a pricing error is made so that everyone can order and then sue for loss of bargain.
And my latest HMV purchase shows that these sites do alert people to bargains and price reductions, nothing to do with suing everyone for "loss of bargain" - a whopping 85% discount on a clearance item/old stock they want rid of.
I'll take my screenshot along with my receipt to show these bargains do exist.
Again, the problem was only with the T&C's that B&Q had in place at the time and despite having previous knowledge of potential issues.
I repeat, B&Q were negligent, all the proof is there to show that - please use it.

Thanks, I've added it to my file. I dare say the hotel chain would prefer not to fulfil the contracts at a loss but they recognise that they are not legally in a position to renege on the deal.0 -
Another lot of bargains today, this time from Ikea Gateshead.
Bench unit reduced from £244.97 down to £9.99 - almost 96% discount.
Shelves reduced from £2.97 down to 1p - almost 300% discount.
Towel rails reduced from £3.97 down to 9p - almost 97% discount.
Along with my HMV 85% discount and all within the week, so yes these bargains do exist when companies are clearing stock and probably more so in this economic climate.
Lots of receipts and proof of these discounts along with a declined offer from Dixons of the washing machine which I didn't follow up with because the T&C's applicable at the time did not form a legally binding contract (Pocoyo this was your find, did you order and get the reply from Dixons??). So I can prove that these offers do indeed exist and yes others including errors are declined because of the T&C's.
I'm happy I can show this wasn't a price error and these deals do appear very regularly. I can prove I don't always go for "loss of bargain" when offers are declined. I can show how a legally binding contract was formed by showing acceptance of my order. I can show B&Q never ever stated it was a price error. I can show I have fully tried to sort this out with various emails and letters to B&Q, willing to accept either comparable items or compensation. I've also got the two different sets of T&C's, both old and new which show why one set allows a legally binding contract to be formed and one doesn't. I will ask for the Beckitt v B&Q case to be considered as per the "discretion" ruling. I will ask if the "discretion" clause is an unfair term. I will state B&Q were fully aware of the issues regarding that their T&C's allowed for a legally binding contract to be formed due previous claims, yet did nothing to correct this until after this new issue.
I will show my emails from T/S stating should B&Q be able to supply me my products I would not be able to claim "loss of bargain". I can show legally how a contract is formed and have the relevant info regarding the S of G's act 1979.
Lol, I must have even more but my head is hurting, but do I need more??
I'm a happy bunny - BRING IT ON. :money:

Hi Lynsey,
Yes that was my find however I didn't order one myself because I wasn't in need of a washing machine at the time; I just wanted to pass the tip on to others who did.
In the past 6 months I have ordered two beds but received neither, in both cases the companies had terms and conditions which stated there was no contract until delivery. One turned out to be a pricing error, the other was a simple lack of stock to fulfil orders placed. It's disappointing but at the end of the day there was no contract so that was that.0 -
The other thing worth noting is that B&Q do have regular clearance bargains, kitchen doors etc, rugs etc. Maybe worth trawling this site to find these previous clearance bargains and print them off.

I have the evidence of the kitchen door clearance sale in my kitchen.
£1 per door, I think off memory it was something like a 92% discount.0 -

Exactly, it's all there - now where is that thread??
Edit: one thread here http://forums.moneysavingexpert.com/showthread.html?t=985749 £25 doors for £1.

So why would we assume it was a pricing error??
B&Q do these types of clearance bargains all the time.
BP, get your thinking hat on please, you want to use forums as evidence and so shall we.
