Me too. If it gets to court stage, presumably it's just your local court house? I've never got to the stage as others have always settled before it got there... Abbey bank charges for example.0 -

Interesting times ahead.
Do Bond Pearce have an angle on this, or are they the one's to negotiate/reach a settlement to avoid litigation??

Nothing to be feared from Bond & Pearce. First case will always be the guinea pig, and mistakes made will be learnt from for subsequent cases.
If i had a battle this large, i would not want to stand up in court myself, but bring in a firm, then when it goes all wrong. Pass the blame onto them. When it goes right, take all the praise for bringing someone in.
Courtcase wise its an away win.
B&Q - 0 , General Public - 1
If the dishwasher brings in £200 per case for example, then that could be anything up too £20,000. Add in the water butt, then that could be £1000 per case. Throw in another 100 people and thats another £100,000.
So with 100 people claiming for the dishwasher, and 100 more for the water butt, thats £120,000 there down.0 -

100% agree. There is too much for B&Q this time, a massive time factor.
Nothing to fear at all. If it ends up in court, we put our case, they put forward the case of B&Q's and the judge decides - that's put in the simplest form. We either win or lose, either through court or negotiation.

From the Bond Pearce web-site - enough said! Perhaps they should have been brought in earlier by B&Q!"You can take a chance selling online," says Andrew Kimble of lawyers Bond Pearce. "But get it wrong and the consequences can be severe - not just penalties for breaching regulations, but adverse effects on a business.
"Get your online trading terms wrong, for example, or fail to structure properly a fulfilment or hosting agreement and the costs may be high."0 -

They shouldn't have been brought in at all, very, very amateurish for a PLC of that size. They didn't even learn from the dishwasher fiasco and only tightened up the T&C's after the latest episode, and even then it took quite a while.
The B&Q management have a lot to answer for, but no doubt they will look after one another at that level.
My wrath is aimed at their total disregard to even attempt to sort this matter and more or less said, "If you want answers you will have to pay for them" - unbelievable lack of customer care from anyone, let alone from a large PLC company.
I just wish I could press the fast forward button rather than sitting and waiting to see what develops. Will BP negotiate to minimise losses?? If not there is a lot of costs involved attending all the hearings - solicitors don't come cheap and BP aren't exactly small, and if we win the total claim will be massive.
