I spoke to B&Q to make sure they received the claim and it seems like they are being timetabled. Expect all claims to be hit with defence and then offers of settlement. though whether anyone wishes to take £100 when there is £900 on offer via the court begs another question. Well done Payless.

As I have said, B&Q will only pay when a court summons issued

I think because of the high value this time as oppposed to the dishwasher case, then offers will probably be made.
I wish they had done this from the start, they would have shown some credibility knowing the state of thier T&C's.
What has gone from accepting maybe £20 in B&Q vouchers has now become a minimum of £1000 for my two tanks - and that's down to them.
So it depends what each person is willing to take if an offer is made, or if they are prepared to go/appear to go the full way.

yes, bear in mind all that we have a blo ody strong case against B&Q and for a little more nerve holding,it could be worthwhile.

The previous tactic was to offer £100 which expires just before the court hearing. However, if you reply and state not acceptable, you will attend court, you will find a couple of weeks before the hearing, an offer will be made. the £100 or so offer is a knockout round. Some will settle, but having spent £60 on court fees, £40 gain isnt much and doesnt get you into the financial position to buy another one.

Just to clarify, we don't have to accept any offer made which is less than our claim, now we have commenced legal action.
Obviously for me anyway, a very good offer will probably be accepted - along with a very good apology.

Regarding time limits for B&Q to respond/defend, this is taken from the Money Claim website:

"The Defendant is allowed 14 days from the date they were served with the claim to defend or admit your claim before you can request a Judgment by Default.

If the Defendant files an Acknowledgement of Service within 14 days of receiving the claim form, they will be entitled to 28 days from the date they were served with the claim form to file a defence or admission of your claim. If the Defendent does not file a defence or admission within the 28 days you can request a Judgment by Default.

If you have not requested judgment, the defendant may still file a defence to your claim after the 14 days or 28 days have elapsed. The claim will then be transferred to your local court for a hearing to be arranged."

Had a letter from Northampton County Court today advising me of a change of solicitor to Bond Pearce from B&Q acting for themselves.

Hardly surprising considering the amount involved this time.
At least if we lose, it will have cost B&Q a great deal more.
