Although the recent ruling related to t&cs for landlords and tenants, the following is interesting:
OFT Chief Executive, John Fingleton, said:

'This ruling sends out a clear and unambiguous message that businesses offering services need to ensure unexpected or surprising terms are not hidden away in small print. Contracts need to be written in clear and straightforward language with important provisions, particularly those which may disadvantage consumers as in this case, given prominence and actively brought to people's attention.'

If anyone has had an email/letter since 08/07/09 from B&Q stating they have no stock of these Argonauts, can you please reply below.

This was a ruling against Foxtons for Unfair Terms in Contracts which is highly relevent.

There has been cancellation of orders from Dixons and Fortnum and Masons reported on the grabbit boards and on checking their terms and conditions, it would seem they have a newer style of terms which forms a contract on dispatch etc, now like B&Q.

B&Q has confirmed safe receipt of my claim today via email. Looking forward to the second hearing.

    My claim acknowledged also.
  • I've just noticed that my claim is lodged at the Northampton County Court.

Odd, since I live in Gloucestershire and B&Q are in Hampshire.

Don't worry, Northampton is just the nationwide handling centre for all claims made online. As soon as a defence is entered they work out your nearest court according to your postcode and transfer the case there (it all happens automatically, you don't have to request it).
