    the judge wouldnt agree with that nor would the Sale of Goods Act.

    I wonder just how much TS works for the customer rather than working to help the big boys?

    That was exactly my sentiments as well. They did appear to suggest I was being awkward, but also agreed there was maybe a case.

    It doesn't matter a jot how it was labeled except to make it appear that b and q have a get out clause when they don't. The t and cs change speaks volumes

    Fully agree, if it was that easy to use a simple term to get out of a contract, then everyone would do it.
    They do seem to be grasping at the "error" in everything they write.
    Errors=costly mistakes.

    The judge said to me errors happen but a contract was formed. We bought something and we should have it.

    Sorry to " butt" in on this at this late stage. But I have read back as far as I can and don't understand what is happening! I had an order for this and a cancellation letter. should I be doing anything?

    Basically B&Q have been sued once already in court for the difference in price between the cost of a product and the market value. as the argonaut was £50 but will cost £970 elsewhere, you can sue for the difference.

    I found almost 40 people on the MSE site who said they had ordered the tanks - I haven't trawled through the other sites. Does anyone know how many have filed claims and how many are waiting to see what happens before doing so?
    I too wanted a negotiated settlement - and the tanks or equivalent - but just got rebuttals (sorry!) from B&Q.

    B&Q have been a disgrace, totally refusing to answer any questions and thus forcing customers to either accept their answer or to sue - no middle ground at all, no reasoning and certainly no compromise. I'm fully prepared to gamble £100 plus any extra costs involved to get an independent decision.
    Poor customer relations from what I can see and if they do get hit with successful claims - they deserve it.
    Luckily the staff at my local B&Q are quite different - very helpful when asked questions.

    based on emails I have received there will be a deluge of claims when the first case is WON against B&Q in court. some seem to be hlding back until a test case goes in for the Argonauts. i fear someone is one day ahead of me on claiming so i may not be the first.

    I too have given B&Q every opportunity to help themselves and they have gone very quiet with me as well. oh well, at least i can demonstrate to the judge i tried
