about to fire off the small claims... now I ordered 2 tanks from B&Q..

Do I do it as one for both tanks or two claims for each tank seperately?

I'd like some advice on this too. Ordered three on my card, 2 for neighbours & one for us. Is it possible/better to claim for them seperately? I'm thinking it would look less "greedy" iyswim. But would claiming just for one initially mean I couldn't claim for the others?

And does anyone know about the claim costs once you go over the £1000 mark? I can't find the details for trying!

If you claim for two via moneyclaim it will cost you £80, see here for guidance on fees:

I would have thought you would need to make one claim for each order ie each invoice raised.

maybe someone with a lot of time of their hands moaned about the link in the first place. Not that it is benefitting me in anyway, except probably to advertise B&Q

Maybe a few people are taking the view that the website, twitter page, quoting your name in the BBC Watchdog email etc. is an exercise in self-promotion rather than helping people! Then again, nothing wrong with self-promotion. :o

On another point (my apologies if this has already been discussed):

I checked the B&Q T&Cs just after the dishwasher hearings, and the T&Cs on their new online ordering site www.nextdaydiy.com are different, with the infamous 'discretion' clause removed and other relevant clauses too (regarding when a contract comes into effect).

Here are the new T&Cs: http://nextday.diy.com/app/jsp/home/informationPage.jsp#PTC

BUT on their www.diy.com (which is now more aimed towards reserving and picking up products in store, although you can still order via this site) the T&Cs remain the old ones (albeit they are quite hard to find).

So...people should be careful that B&Q do not attempt to use the new T&Cs in courts if you made your purchase via the www.diy.com site (assuming everyone purchased via the old site url).

Some nitwit has not updated the T&Cs on the older site.

there is a difference in promoting your business, i.e. spam links then actually something you set up to help other people. some people clearly think that helping others falls under the 'whats in it for me stake'. Not being cryptic.

So why have you stopped posting the link? I didn't say anything about posting spam, you just seem unable/ unwilling to answer my question?
    Gone ... or have I?

Their email to me referred me to their terms and conditions
    in their support section:
"Whether or not you receive the e-mail, our acceptance of your order will create a legally binding contract between us. We reserve the right not to supply you at our discretion."
Is the one not almost a contradiction of the other?

top tip - go through and try and place an order and you can have 10 points if youcan spot where it asks you to agree or even read the t&cs before you buy.

    .

it is very important to get across that i am writing and basing the site on a personal experience and not a personal vendetta against B&Q for all manner of legal reasons. The twiter page is to give people fast updates rather than trawl threads and the BBC watchdog email is useless unless you name who took them to court so they can verify the story quicker and hopefully use it. You will be interested to know that B&Q and their external legal team have been poking around the site today.

p.. the water butts were never for sale on the next day delivery site, so they wont be using them. they have referred to discretion which is in the old t&cs

Which is unbelievable considering the term "discretion" has been shown to be no good whatsoever when there is lack of stock.
Have a look at say Argos, watertight T&C's compared to B&Q's discredited ones.
    How long will it take??
How many times do they need to be "hit over the head with a hammer" before they realise it hurts??
If these claims againt them are successful they will become a laughing stock.
As long as these silly T&C's stay in place they will get "hit" everytime they make an error.

    Another excellent viable point.
