p.. the water butts were never for sale on the next day delivery site, so they wont be using them. they have referred to discretion which is in the old t&cs

That's good! But nonetheless it's probably worth pointing out on this forum that the T&Cs are different on the two B&Q sites, in case other similar cases arise and people try to rely on the arguments in the dishwasher/water butt arguments.

top tip - go through and try and place an order and you can have 10 points if youcan spot where it asks you to agree or even read the t&cs before you buy.

This is what I'm referring to above, it very difficult to find the T&Cs on the old site, they all but removed them apart from in the Help section. One has to really dig to find them, which is why I thought they may try to rely (wrongly) on the new T&Cs (which are very clearly available on every page of their new site). But since they have already acknowledged the old T&Cs and the discretion clause, that won't be a problem.

It quite unbelieveable that they've not bothered to change their T&Cs yet.

So why have you stopped posting the link? I didn't say anything about posting spam, you just seem unable/ unwilling to answer my question?

Can I ask you a question - why are you so interested in this thread, and the associated dishwasher thread? I've never seen you post anything useful, you just seem to be continually teasing and goading Tom, to try and get some kind of reaction out of him. What's your problem exactly?

taxiphil, over various threads Tom had been pulled apart - this type of thing happens on lots of other sites/forums as well.

I maybe wrong, but I think jealousy plays it's part. We have someone here who has come to the fore on this site and some will not like that, but what Tom is doing is what Martin has done lots and lots of times - look for loopholes - that's Martin's expertise.
I've said before, Tom doesn't have to help others, he could just help himself - he is a credit to this site.

Their email to me referred me to their terms and conditions
    in their support section:
"Whether or not you receive the e-mail, our acceptance of your order will create a legally binding contract between us. We reserve the right not to supply you at our discretion."
Is the one not almost a contradiction of the other?

    Thay need to include this:

    2.3

Most other sites have something along these lines.

awww, i may cry now, but be brave ol Beckett. still upper lip old chap. I went into B&Q earlier to buy a hose and the chap at the door was so nice. B&Q do one thing really well, they employ older people who clearly enjoy their job and take care to be nice.

and make you tick a box to say you accept the T&C's although I am sure you have better chance of spotting Bin Laden on googleearth than find them on the B&Q site.

For the site we print off for proof of loss of bargain is it the 15mm or the 22mm we are comparing with? What do these two figures represent anyway?

Also it doesn't seem possible to print that site with the price of the items included - the price disappears both in Safari and Firefox.

EDIT - works fine in Safari just not Firefox.

(btw many thanks to Mr Beckett for all his advice and to others for their contributions too).

Also, I'm no expert, but having had a look at the excellent template letter, should it not also give B&Q the option of supplying a similar tank in order to appear to be totally fair?

A few tips for minor improvements to the template letter:

    1. "I ordered a the above" (get rid of the "a")
    2. "Several days later, I was contacted by B&Q"
    3. "At no stage in the order process was I asked to view the Terms and Conditions nor asked to click to accept them." (I think that's the correct grammar)

  • Hi guys, first posting here.

I am also in dispute with B&Q over the non-delivery of two water butts.

On the terms and conditions, I am in receipt of an email from B&Q customer services department refering to the diy.com ts&cs. The email even gives me the link.

    Which is helpful.

The nextday ts&cs refer to a head office in Yeovil, which makes me think they are part of the Screwfix operation rather than the B&Q stores business.

    hope this helps,
    jpi
