LLoyds still looking for information

I have been lurking here for some time to get inforamtion about claiming miss sold PPI on a LLoyds load that I took out 4-5 years ago.

I used the letter templates, thanks BTW, and sent them off. Lloyds sent me a letter to confirm that they were looking into the issue, and then another after 4 weeks. I called them yesterday to ask for an update. (the 8 weeks are up on the 24th). They informed me that they were still looking for the signed loan forms. I informed them that I have a copy of our agreement.

Lloyds has have requested that I send them photocopy of this agreement. This agreement is only the customer copy (with no signatures)

Q. Do I have to send them in? (I did offer when I made the complaint, but was told that they did not need it)

Q. Will it affect the claim, if I do or do not send the agreement in.

What if they cannot find their copy of the agreement?

    Hi John and welcome

    Strange that with Lloyds asking "you" to supply them of the copy of the agreement, they should still hold your details.
    I take it you live in England or Wales?
    Scotland I am aware they hold information only for 5 years.

    They have with mine sent me a copy of a credit card agreement going back as far as 2001.

    I would write back and tell them, "they should still hold your details" which should be kept on microfiche, and if they are unable to supply this to you, you will consider contacting the Information Commissioner Office (ICO), in-fact I would write to ask for this and enclose a postal order or cheque payment of a £1 to cover for this request, they should supply this through the post by 12 days, post by recorded delivery. (data dept)

    Then if they do not comply to this request contact the ICO here:

    And explain to them your situation, as you are trying to make a claim on a mis sold policy, ask if they are able to contact them on your behalf.

    In regards of your 2nd question, if you know for definate you were sold and mis sold this then it should not really affect your case here.

    If your copy of the agreement has no signatures on it then they can't use it to defend their case because they can't prove you signed for it.

    I gave Lloyds an extra month in order to try to find their paper work.

    When I spoke to them that said that they were still waiting for it. I asked them to send me a letter informing me of the current status, and they said that as the complaint duration was now over 8 weeks I needed to contact the FOS about try to resolve this complaint. They said that they would not put anything else in writing and I still have not received a final decision letter. I asked them what is the maximum timeframe for them to locate the paper work, they informed me that there was no maximum. I then asked what would happen if they could not find the paperwork and how would they know if they could not find the paper work? They did not give me an answer, but again told me to contact the FOS.

    I gave them an extra additional week, in addition to the extra month and then I sent all of my paper work (scanned and re-printed) with a copy of all of my letters to and from Lloyds last week.

    FOS sent me a standard "we have received" letter.

    What is the average time for the FOS to investigate complaints at the moment?

    Iwould just contact FOS now and pass the complaint over to them. As regards if they do not find the paperwork I would think FOS will rule in your favour eventually is you have proof of PPI in your agreement. I bet they will suddenly find it though.

    I had the same trouble with my bank and I asked fos about what would happen and they said that they would eventually rule in my favour if they did not send the file. They did however send it and also a goodwill gesture as well so no adjudication was required.

    I spoke to the FOS this morning. They have informed me that they have a delay of 3-4 weeks due to the back log. They will then be able to look into my claim.

    I asked what was the average complaint duration......and was informed it could take a year.

    Oh well. Lets see what happens next.

    It can sometimes actually be a lot longer than a year now from people on here but they do seem to do redressing in batches just lately. Don't know if they are hammering each firm at once.

    Minor update.

    The FOS have sent me a letter saying that they have requested information from Lloyds TSB.

    carry on with the waiting game.
