Sorry to say that in the last 18 months (and apparently for the last 2 to 3 years at least) both the Information Commissioner and Ofcomm are pretty much as useful as a chocolate fire guard. Just look at the BT tests of Phorm's Webwise system on thousands of BT customers without even asking for their consent...
According to one aspect of the invention by Phorm, user activities can be monitored during the entirety of each user session without regard to the particular websites being accessed, search engines being used, or other specific resources employed. Information from monitoring each user session may come through the user's service provider, e.g., ISP. Thus, the whole of each user's experience from onset to termination of their network connection can be monitored.
You can find the above in the patent for the Phorm Webwise product. And what did ICO or Ofcom have to say? Not much.
One thing was clear tho: It must be OPT IN. So how come this database of mobile numbers is Opt Out?
Do everyone a favour though if you want the detail removed. Use a Data Protection Act Section 11 Notice to tell them they are not to use the data.
You can find an example of this notice via the Dephormation website which will create a DPA s11 notice specific to the Phorm Webwise issue. Just amend to suit the 118 800 problem. Site: https://www.dephormation.org.uk/dpa_notices/
People should be free to CHOOSE to add themselves to these types of service. I should not be an Opt Out issue though (IMHO)0 -

I agree with you CLLC, it should be an opt in not an opt out choice.
