Plazma TV fell over now broke can I claim?

    My son regularly pushes the 42" plasma about, now we have secured it to the wall using flymo chord with a washer around it on one side. It feels stable as it sits on a large glass stand.

    Many times we find him bashing it with toys etc, so can see how this can happen.

    I'm glad you've fixed the TV, but surely you need to stop your son just bashing whatever he wants.
    I would never have been allowed to bash my parents property as a kid. I would have been dealt with until I'd leant my lesson and not allowed to do it more than once.

    It's not really what I would call a "moral" judgment, it's more matter of risk.
    They will make judgements if people take risks beyond what would be expected to be normal and they tend to call that neglegence.

    I'm speaking generally as having a TV on a stand is quite normal.

    The TV is covered for accidental damage - the child knocked it over. I would be very surprised if any insurer turned it down due to "negligence" of the parents - it was an accident, it's what we pay premiums for, surely?

    Fraud is another matter - if the insurers had any reason to believe that the child didn't knock it over and it was done on purpose to get a new TV, then they would be right to turn it down. That doesn't appear to be the case here as the OP is looking to get it fixed.

    I really cannot see how a 1 year old can reach up and change the centre of gravity that much on a plasma. a 4 or 5 year old may be but a 1 year old?

    They can do and someone posted a while back where they had to jump through more hoops to prove what they said they did as the claim didnt sound right. Technically, what they said happened would be covered under accidental damage but the logistics of what they said happened just didnt sound right and it smelt fraudulent.

    The problem with claims like this is that the genuine claims smell bad because of the high number of consumers that put in false claims.

    Depends where they draw the line.
    Accident and negligence are not mutually exclusive as you seem to be suggesting.
    That's just my view and I'm not seeking to get out of paying a claim.

    I'm only speaking hypotetically here as an exmaple and not accusing anyone, but what if they were blind drunk and were playing football in the lounge.
    If the TV is heavy then the insurer will KNOW it's fraud and a 1 year old can't push it over.
