  • Hi

    Does anybody on a DMP have Vanquis as one of their creditors and if so how have they treated you ?
    So far most of my creditors seem to be liasing with CCCS but Vanquis call me constantly at least 5 times a day.

    Hi all,

    I am 16 months into my DMP and everything was going swimmingly with very little hassle except HALIFAX loans who pestered us to the point of us changing our phone number (ahhhh peace!)

    The only problem is now they cannot contact us by phone, they have immediately passed us onto Moorcroft without warning which is fine by us tbh. We rang CCCS to inform them of the change and they said they would contact them on our behalf and to not ring them.

    So, 2 weeks later I have just received a really nasty letter from Moorcroft stating that we have not made contact and they are starting proceeding unless we contact them immediately. We rang them and they were AWFUL on the phone - no-one from CCCS has contacted them and they need payment NOW. Of course, CCCS are now shut until tomorrow and we are left in a right panic.

    My question is, has anyone been down a similar route with this company? Do they tend to accept CCCS offers of reduced payment? Are they generally going to leave us alone or pester us??

    Just going to have the first troubled night sleep for a looonnngggg tme due to our debts.

    On the plus side, NR are being delightful!!

    Hi All,

    I am so pleased to back in the game after a long time abandoning you all. I am nearly at the end and hope I can offer some hope to those just starting out. My life is transformed with sorting out my debts and my 1,000 watt lightbulb moment seems more like a dwindling match light now.

    One tip I can offer to all of those who are receiving nasty telephone calls or those of an intimidating nature. Stay calm. Record it on your mobile if you can. If they refuse to give you their name ask to speak directly to a supervisor or manager within their team. Log the time and date of the calls. Then send it all in and log a formal complaint in writing. Read below. If they make any threats to "jump the gun" and come to your house while you are making token payments and ignoring your letters, just quote this. Also, ask them not to call. As soon as you know who it is calling, just say "I will not enter into telephone debate regarding my debt with you. PLease make all communication with me in writing." If they refuse this (which they cant) just tell them you are terminating the call. It works. Honest.

    I enclose a quote that it is actionable if you can prove it. I used this with Creation and MBNA and all communication was then in writing and still is.

    Section 40 of the Administration of Justice Act

    “S40 Punishment for unlawful harassment of debtors.
    1. A person commits an offence if, with the object of coercing another person to pay money claimed from the other as a debt due under a contract he-
      • harasses the other with demands for payment which, in respect of their frequency, or the manner or occasion of making any such demand, or of any threat or publicity by which any demand is accompanied, are calculated to subject him or members of his family or household to alarm, distress or humiliation;
      • falsely represents, in relation to the money claimed, that criminal proceedings lie for failure to pay it;
      • falsely represents himself to be authorised in some official capacity to claim or enforce payment; or
      • utters a document falsely represented by him to have some official character, or purporting to have some official character which he know it has not.

    Evening all!

    Cheesypuff & tinkerbell12 - KPR (briefly) took over my Nationwide OD before passing over to Moorcroft. Both have been er, not nice. Doesn't help that there was some confusion over my address which resulted in no post being sent to me till I'd confirmed my address, which also caused problems with sorting out my remortgage! Other than that, haven't heard from them for a while.

    Muddlemess - I paid off a HFC (DFS) debt at around 50% of the debt owed this month. They said they'd send me a letter to confirm this, but haven't had one yet, and they said they'd mark my credit file as 'satisfied'. PayPlan's thought on F&Fs was that it could be viewed as preferential treatment towards one particular creditor. I managed to get round that as the total debt (£150) was so small as not to matter too much. I hope.

    Evening all, Thanks for that info jillyojolly, I'm sure we'll all have lots of questions to ask along the way. I'm about to make my first payment and have received letters back from most of my creditors, still the odd few that I haven't heard a peep from, but assuming were all good to go.

    tinkerbell, sorry you are feeling so low, I know the feeling off going to bed and not being able to do anything other than lay there and think about money! I hope you manage to get this sorted out with CCCS in the morning, and at the end of the day, there's nothing you can do over night so try and get that drilled into your head and it will help you to let go at night and relax.

    has anyone had any dealings with a payday loan company?? I have one which the full re-payment is due on Friday, i called them to say the money wouldn't be in the bank and could they cancel the payment ect ect. they said they can't do anything until they have requested the payment and it fails, then it will go to the next stage. my question is if payment is due surely i will need to make a token payment before they receive mayment from cccs in july, so how do i go about paying this? should i just call them friday when the payment fails and see what they say> i've heard they can be quite agressive. Thanks in advance

    and to Moany Money - can you programme the robot to tell the staff there that the extermination comes from me too!!! - I have a £300 quid debt with them (all charges) which they put me on a managed overdraft for and they didnt really seem to care that I couldnt afford it, and they got all snotty when I defaulted!!!!
    I set Kensington on them though - and strangely enough the only peep I've heard out of them since was to accept the DMP!!!!!! :rotfl:

    I have a couple of things under morrcroft and have found them one of the best out my 22 debters lol, they have accepted everything and have stopped hassling me. I do see what you mean about CCCS though about things not getting to them. TBH I think its the creditors trying it on as when i notified all my creditors, some claimed not to have received anything from me when we started but yet marriage certicate copies were received and they were ent together.

    I am currently pushing CCCS at the moment for an additional debt which was added almost 2 months ago now, but we are getting there slowly.

    Just bare with it all as it does take time and we have a real reduction in calls and letters now. Infact my post box is very quiet at the moment. Nothing for 3 days lol.
