Why is it that a creditor which I owe over £8k to have been fine no problems, no nasty phone calls , zip all fine and another creditor - "Naturally Close" who I owe about £96 are constantly calling, making threats to send in the bailifs (what for I don't know as nothing I own is worth anything, all falling to pieces any way) .... are they for real, demanding full payment, constant telephone calls & letters demanding money. I am in a mind to try to pay them off next month with my overtime just to get rid of them.

I am working 70+ hours a week now to try to get rid of all the little ones anyway as the large creditors seem to just let things ride.

Do they not realise that people who are in a DMP are struggling & want to pay off the debts as soon as possible but just can't.

There should be some kind of government scheme
    • The Government give you an Interest Free Loan
    • You agree not to take out any further credit & the an agreed min is taken from your income/agree to pay a min monthly payment - with the option to pay off more when you can (with regular reviews to take account of changes in circumstances) JUST LIKE A DMP but without the hassle
    • Your Creditors are paid off
    • No-one chases you for the money
    • Your debts get paid off without increasing
    • You are not stressed
Afterall the government got the country in a mess financially, they are bailing out all the companies who ask for help... What about all the people who are affected by the credit crunch who are now in debt.... I was going to sell my house this year & pay off all my debts in one swoop, but because of the credit crunch my house is now in negative equity which means I will not be able to pay off my debts like I planned, my kids will not be going to the school I want them too because I cannot move house.

Anyway I am rabbitting on a bit now so will hush.

:money:How about it Martin can you use your weight to get a scheme like this up & running.

Its like an IVA only you actually pay back the debts, unlike the IVA you only pay back a percentage.

I guess the reason why a creditor to which you owe £96.00 will breath fire is because a) They know that it would be crazy to take you to court, as it would cost them too much and b) They might have a chance of full repayment, if they bully you a bit..which, seems to be working in your case as you say you might pay them off just to get rid of them.

This happens so often as some people give in due to the stress of phone calls and letters etc. What you learn on this site is not to give in to threats and bullying. As is quoted so many times 'You can only pay what you can pay..nothing more!'.. But still some bend under the pressure..which I can understand having been there and still being there. The other secret is to communicate 'everything' in writing, never by phone.. It takes some of the pressure off your shoulders..believe me..
  • Hi all,
My ongoing battle with NitwitWest continues. 2 letters from them today. One saying that I haven't been in touch with them over my loan + overdraft arrears (err hello, CCCS have wrote to them on numerous occasions) and now they will pass it to the recovery team who will "take legal action which may involve bankruptcy or repossession proceedings", "Enforcement action which may involve attachment of earnings" and "Passing details to Debt recovery agents to pursue you for payment, which may involve personal visits to your home"
OK......now as far as I know they cannot enforce any of these unless I fail to make a payment on a CCJ (which hasn't been issued yet) apart from passing it to debt recovery.
The 2nd letter thanks me for informing them of my DMP with CCCS and they await details of repayment proposals........for the God knows how many times!!!
Any advice on what to do here ?

btw I saw the new Transformers movie last night and so wish I could have a pet robot to send and trash the Birmingham Collections centre!!!! ;)
I'm always in the brown stuff (marmite)....only the depth varies!!! :rotfl:

symesd - Naturally Close I think are part of the JD Williams group and I've had more run-ins with Reliable Collections than I care to remember (both on my behalf and my mate's - like I said in my post last night they thought it was acceptable to send a forged CCA!!)
They are bullies, this lot. My mate had them ringing her 8 or 9 times a day then of course they flatly denied it!!! At first they denied that Kensington had sent them anything (I busted them on that one, I also busted them breaking several of the OFT guidelines)
And by the looks of it they are clearly breaking one here if they are communicating with you rather than the CCCS. When they ring, say to them 'you need to speak to CCCS. Goodbye.' and hang up. If they carry on, send them a letter pointing out they are breaking OFT guidelines, that you will be reporting them to OFT who could revoke their licence. I've lost count of the times I've lost my temper with this lot - they are trained to ignore DMP's it seems so dont let them get you down!!!

    Afternoon all
what lovely weather to be sat drinking a nice cold (been in the fridge since Christmas) beer! lol

I've shut Nationwide up by sending back their gold card in so many pieces it looks like gold dust lolol i'm easily amused. That gives me three months peace anyway...

... another good thing is Alliance and Leicester have accepted reduced payments on my outstanding loan (of about 1400 squids) but will nicely charge me £25 every time they write to me  and if I go into arrears by the amount of two 'normal' monthly payments... I look forward to owing them thousands more in interest and admin charges and reclaiming it all back when i'm in a bad mood :rotfl::rotfl:

Not heard a peek from MBNA or Lloyds...

Have opened a Natworst Step account and a linked savings account (which required a credit check :rotfl:) so that I can start that all important budgeting for car repairs, MOT's, tax and birthday type things.

    It's all an adventure!!

    CA xx

P.S came clean about everything to my mum last night so well chuffed.. lightened load and all that.. she said I was doing the right thing and that the banks can stick their greed and interest where the sun doesn't shine :T I think Martin would agree...
Proud to have dealt with with my debts
Debt free from 18th March 2013, long may it continue!

HA HA, I've highlighted the main parts of your quotes! Although I've not been on here very long from reading others posts it seems that they do try letters with lots of 'maybes' and 'we could' but I too don't think they can do any of this without a missed payment on your CCJ (although please don't quote me) I'm sure someone will let you know if I've told you wrong!

They can send someone to your house but from reading others posts, (don't know what i'd do without this site:T) this is usually very unlikely as it costs so much. Plus think there is a letter somewhere (maybe someone can point you in the right direction) which, if you get a letter from the DCA telling you someone will be calling, you can send to them to inform them of your rights and that only certain people, i.e postman or binman can enter your property without your express permission and if they do you are within your rights to call the police for tresspassing, (something like that anyway).

Here here to the transformers robot, if you find one you'll have to retail them - you'd make a fortune!!

Hope this has helped a little and sure someone with more knowledge will be along soon. xx

    Hello All

Just following on from the posts by Symesd and Moaney Money, you may have seen this before, but here's the insider guide to how debt collection agencies work -
    http://www.consumeractiongroup.co.uk/forum/debt-collection-industry/126018-barclaycard-mercers-insider-info.html

Makes quite good reading - especially stuff like ..'

Remember it is all a big game to Barclaycard and they expect to lose money through people not paying. They just bank on conning the people that do pay enough that they can afford to do it...'

Hope everyone is well on this sunny day :j (well it's sunny where I am!)

Having terrible hassle from KPR who are Nationwides in house debt people. Had a phone call last night from a girl who was really nasty and started to ask me questions about my utility bills and mortgage and stuff and why I was in a mess. I told her to contact CCCS but she said they had to call them or litigation process would start.

I rang CCCS but don't fond their aftercare team all that helpful always feel they are very vague, compared to the original people on the helpline. Does anyone else think this. They don't make calls to companies so not much I can do really.
