    That's right Twitty, it IS brill to see the amount reducing. Talking of still watching the pennies, OH took me out for a birthday lunch last week with some o/time money he had. I couldn't help thinking " I could make this at home for far less!!". However it was lovely to really enjoy something you know is paid for.
    Woohoo!! Our EIGHTH payment went to Payplan today!! and to think the last 6 months went to Halifax's 6k of added interest. Grrr...:mad:

    Treats like this just help to oil the wheels of a DMP, especially when you have such unsympathatic creditors to deal with. (And how much did their last rubbish advert cost?)

    Hiya,

    Have you checked the enforceability of this debt? (I.e. CCA request or invalid default notice). Also, is this with the original credior or a DCA?

    The chances are that if they are offering such a substancial discount, then the debt is unenforceable and they already know it.

    Had you registered a defence agianst the CCJ? If you defend and win, you could see the debt disappear altogether! (No false promises though, I said could and not would). Alot depends on the judge lottery and if they are clued up on the Consumer Credit Act 1974.

    If you do defend, then it may also open the way to a lower settlement figure without even actually getting to court. This is because crediors often negoiate at the last minute if they think there is a chance that they might lose in court.

    As for accepting their current offer. If that is the way you want to go, then i'd say go for it! I cant see your other creditors kicking up much a fuss as their percentage of your DMP payment will increase when the creditor in question is paid off.

    This has happened on my DMP, but not through settling any debts. I've pulled 3 creditors from the DMP for their non compliance with the Consumer Credit Act 1974 and for mis-selling ppi (which also renders credit agreements unenforceable!). All the remaining creditors are now getting more than double their original amount, so obviously no complaints from them!

    Oh yes, and guess what. All three of the removed creditors are still to take me to court!!!:D:D:D They try to make me believe they will and make their usual threats, but as yet, none of them have. One of them hasn't had a payment since January 2009 and the account is in the hands of the Financial Ombudsman! I'm waiting for a realistic settlement offer from the other two and I'll use the refunded ppi mis-selling money to pay them off!!!

    If you know your rights, they quickly back off!!! My advice is to get clued up on the CCA 1974 and look for similar cases to yours with the same creditor. The Consumer Action Group website is a great place for information with lots of really helpful people to assist you with your queries.

  • I've just discovered a letter from one of my credit cards stating that if I kept up my payments they wouldn't charge interest, yet I've worked out that they've charged me £500 since the letter was sent, keeping my fingers crossed when I contact them I'll get it knocked off.

    ;) Thanks Twitty, lets just say that this company would be better off investing their finances into new (non annoying)TV Adverts rather than wasting trillions phoning and texting me ;)

    Just mentioning the Halifax must have attracted the Gremlins as sure enough, OH and I got a letter each today with £25 charge. "Right, I thought the gloves are coming off now, you beggars"! So I rang them, explained I had spoken to another colleague, who was more than happy for the arrangement to continue. They said there was no charge levied against the account and they had no idea where the letter came from!! Even the ref. no. on the top of the letter meant nothing to them. Who are these people??

    But apart from all that, I am well, thank you Twitty!!:)

    Just thought I would pop in and catch up on posts. I havent forgotten you all and it is fantastic to read that so many have debts going down. Frown frown upon those creditors who are still up to their old tricks - keep going against them - be brave.

    I have to say I still look back and wonder how ever I got myself into such a huge mess and came out the other side. I still live on my DMP budget, just cant help myself, as I still get scared spending any money at all after the 15th of the month! But at least my savings account (I still love saying I have one as never existed in my vocab until December of last year!!) is rather bulky now and we have even planned a trip of a lifetime to NZealand for xmas for a month and guess what - I dont even have to consider any loans at all. YIPPEE

    Initial letters went off on Tuesday. It is all very quiet. Waiting for the post to arrive. I am sure it can't be much longer. I think we will feel better once things have been acknowledged:o At the moment just feel sick with anticipation. I'm sure things will get more positive, won't they

    Hi Everyone

    I hope you are all having a nice weekend. I have just come home from work to what looked like a wage slip, I knew it wasn't as I am self employed ;)

    I had guessed what it was before I had even opened it, thanks to this forum. Yes it was a note from Halifax telling me that a representative will be calling at my house on Tuesday.

    Oh what joy I can't wait ;);):D

    As you know this account is now with The FOS and still Halifax telephone, text and now threaten to call at my home (I take it they mean telephone, but want me to think actually visit me)
    At least I now have some written evidence that Halifax are going to call me even after they have received the data removal letter and the telephone harrasment letter and now The FOS are involved to.

    So thank you Halifax ;)
