    No i havent, i did try with my natwest bank charges as they were more than my overdraft but was turned down flat so hadnt bothered with lloyds, I am having a really tough time of it lately, job is awful, i feel physically sick every morning when I have to go (treat me like dirt!) but have to go as cannot afford not to, my dad dies a few months ago too and am suffering health problems (waiting for hospital appointment) so was pleased that all was relatively quiet on the debt front, but now feel like its all getting on top of me again :(


    Nat West have a policy of refusing all bank reclaim appeals. I now bank with them and was told this by one of the advisors. You would need to send any appeal to the Financial Ombudsman Service. Read the new bank charges guide for further help.

    I would try with Lloyds. After all, if you dont then you will never know. Again, if they so no then take it to the FOS. It is free and only costs the price of the stamp.

    Sorry to hear about your Dad, hope things pick up for you soon. If you are getting depressed about your debt and it is affecting your health, I would write to them let them know. They would need to back off as per the OFT guidelines on debt collection.

    Keep smiling, we all have some dark days. Remember it is only money and they cant have what you haven't got. Keep on chipping away at it and eventually you will see your debt free date getting closer, even if it seems light years away!

    i have seen doctor re the depression and she feels it is more to do with my dad dying, i think its just a combination of everything, I want to go self employed (childminder) but not sure how the CCCS would take this? and also cant do that until my health problems are sorted out, have a scan in a few weeks & may need a hysterectomy, so no good going self employed then needing 6 weeks off (although I dont get sick pay at work so its still a worry). Work treat me badly, I work for a nursery , I often work ten hour shift (8-6) with no break till late afternoon then it's just ten minutes, yesterday I had 8 under 2's on my own, when it should only be 3 under 2's to each adult! its physically & mentally draining!

    A CCA request or Consumer Credit Agreement request is made under sections 77-78 of the Consumer Credit Act 1974 to obtain the copy of the original credit agreement from when the account was opened.

    You need to send a £1 fee with the request letter. Have a lok through the following thread:

    Post a message on the above thread for more advice on this. Neverindoubt is the man for some excellent advice on this subject. He will be more than appy to assist you and will point you in the right direction for a suitable template letter.

    I can understand with the nursery job. My other half is a nursery nurse and she often has days like you. You need to research your rights with regards to the required rest periods. Do you not get a lunch break? She had similar problems at a previous place of work and contacted acas for advice. When the problem was raised with the nursery, it was sorted!

    If they are understaffed and dont have the required numbers per child, then I think am anominous call to Ofsted is in order!!!;)

    I am suppose to get a half hour lunch break during a ten hour shift but dont always get it, often just ten minutes. dont get any other breaks & often go all day without a drink or toilet!
    when I do a 6 hour shift (which is actually 6.5 as it starts at 11.45 & often ends at 6.15 I dont get a break. They are breaking the law i many places, only 20 days holiday not the statutory 5.6 weeks, closes due to bad weather we dont get paid, always out of staff;child ratio, i have rang ofsted but they werent that interested. i often turn up to work to get sent home again as I am not needed so dont get paid, and have just been moved to their other nursery so have an hour and a half travelling each was as opposed to 15 minute walk! I need to get out!!
    Oh people have gone to the owner with thier 'rights' before only to be made redundant the following week or given no hours for a few weeks!!
    when I leave i will be reporting her to 'everyone' but cant afford to loose my job or have my hours cut now!

    Thanks for the advice, is there a letter template around that I could send to Next letting them know that they do not require my signature ;) to accept my plan, rather odd as they never asked for it when they originally agreed :D and I will point this out in my reply.

    No problem, you can keep an eye on your balances etc using the online service and you can email CCCS direct for advice, they usually reply within 24 hours during the week.

    Like you my plan was going great for 10 months and now everyone seems to be playing up ;) I suppose they are bored of accepting low repayments. Most have accepted again though.
